Also if the guy was dead before the dad dumped him back in the car, drove the car out, and dumped the car isn't that also desecration of remains (or whatever it's called)? Seems weird that wouldn't be a charge here.

Cant morally fault the dad for what he did, but you cant just pardon people who do stuff like this. Hopefully he'll have a light sentence.

I don't think the dad should be pardoned and escape all punishment either. He did murder this person, you know, a person who was no direct threat to him or anyone else...

Abandoning the vehicle could be an "oh shit" reaction.

A guy I know got stabbed over a dozen times before (and lived) but they couldn't even get the guy that did it on attempted murder (even though it was targeted, over a girl) because proving intent is difficult by design.

At the very least, he should be charged with removal and concealment of a body, and probably kidnapping charges of his own.

Defense of third persons follows the same basic rule as self-defense: the risk of harm has to be imminent and not simply a possibility at some future point in time.

sure it can be.

the defense can argue that the father was in constant fear of his daughters safety. obviously that doesn't indicate a rational belief in most cases but he is a trauma victim and very easily could have feared for his daughters continued safety and that kind of defense would be a great chance at jury nullification and give the jury an excuse to let him walk for killing a vile scumbag even when he should be convicted if sticking to the letter of the law.
