I don't drink so it's never come up, but I always wondered. If I ever did go out and drink, it'd be my only way to get home.

Obviously they're not as dangerous as a car; but you can definitely do some damage at full speed. I've cracked ceramic tiles and messed up a counter. It weighs at least 300lbs, so going over someone's leg or something could be pretty bad

Hmm its apparently determined on a state by state basis. I found a case in my state where a drunk wheelchair guy rammed into a truck, but it was ruled he couldn't be charged with DUI as he was still considered a pedestrian

There's no functional difference between his pedestrian mode of travel and vehicular.

It's like the polar opposite of "you can't drive a horse drunk because the horse is sober:" at no time is he NOT operating a motor vehicle.

You make a decision to ride a bike.

If using a wheelchair drunk followed the same protocol it would be illegal to serve a handicapped person at a bar.
