Every state is at will except Montana, and all that means is the employer can fire employees for any reason not protected by labor laws. At will doesn't mean employers can extort employees for things out of their control.

But that would only raise more questions. Like...if they believe the employee was legitimately involved, why would they not just fire him outright and threaten to get law enforcement involved if he doesn't pay them back, ESPECIALLY if it was considered armed robbery? I've worked Asset Protection before, and the minute someone steals, they're immediately terminated and forced to pay back the value of whatever they stole. And this was for much less than the amount here.

Why keep him on the payroll for a year if they truly believe he assisted in stealing $4000?

my wild guess would be: because the business is actually trying to be very very nice about the whole situation.

I mean who would be so phenomenally stupid as to write up a contract basically extorting a worker otherwise? "Money was stolen on your watch so you have to pay it back"? Like how would that even hold up in court? The employee does not assume some sort of shareholder stake in the business.

For one reason or another, they seem to believe they can get away with it.

There's a lot of cases where employees get mistreated by their employer, but can't afford to take them to court.

This wouldnt hold up in court if someone decided to push the issue. Companies need to build a paper tail on someone before letting them go, even in "At will" jobs.

This is one of the things they taught me in management classes back in the day.
