You have to have enough actual evidence to arrest someone. At least if you wants the charges to stick. They probably did some new DNA tests or whatever with updated technology since 25 years ago.

At the time they had probable suspicion and some evidence but not enough. If they took him in then they wouldn't have had enough evidence to prove anything, he'd get off and wouldn't be able to be charged again. by waiting, the technology advanced, they were able to do new tests to prove their findings, and arresting him now will make it that much easier to get a conviction.

I know this isn't how it works but I'm imagining a guy in my head just working this case and this case only for the last 25 years, with a huge board with pictures and yarn and all that shit standing up and screaming "I FUCKING GOT IT" and arresting this dude.

Sometimes they'll have a retired detective or two work a cold case. Those guys get bored in retirement and it's just one case so they can work every angle.

It will be interesting but I think what they did was to establish that her DNA, and the DNA of the Flores', father and son was in the soil behind the house where she was buried originally. And maybe the forensic pathologists were able to show Smart was in contact with the mattress found in Flores' dorm room after she was dead.

therevis no statue of limitations on murder a person can get life for at any age even if its 50 years later

Yea thats just peak cockiness. In the immediate aftermath I understand not wanting to draw attention to yourself, but within the last 24 years at least? Didnt even make an effort, just thought theyd get away with it forever. I mean Im glad they were stupid enough to stay but they could have easily gone to another country and erased any trail to them.

It only happens when they can make the case in court. You only need enough evidence to get a conviction. In this case they probably didnt think what they had at the time was substantial enough, but thanks to newer technology they were able to make a stronger case.

Then in 2019, they interviewed at least one new witness that had not been previously interviewed. Parkinson attributed the "Your Own Backyard" podcast for bringing that new information to light.

someone who was renting on the parents property would hear a watch alarm go off at that time, sometime after she disappeared. the dad had laid concrete down for a patio.

highly recommend listening to the podcast (Your Own Backyard) about this case, the guy who made it did a really good job.

cool to see the area I grew up in make national news and glad these two dickheads finally got arrested. Itll be interesting to see what happens to the mom as well.
