Cristian died on Tuesday in his family's mobile home in the Houston suburb of Conroe while sharing a bed with his 3-year-old brother under a pile of blankets in an attempt to stay warm, according to the lawsuit.

The sixth grader, who migrated to the United States two years ago with his family, was a healthy boy who on the day before his death was playing in the snow for the first time in his life

But the lawsuit -- filed on behalf of Maria Pineda and the estate of Cristian Pineda by attorney Anthony Buzbee -- contends that power was turned off for "those who were most vulnerable to the cold."

"Hence, there were images of empty downtown Houston office buildings with power, but the Pineda's mobile home park was left without power," the lawsuit reads.

The lawsuit blamed ERCOT for misleading customers by assuring them the rolling blackouts would be temporary.

"The blackouts instead lasted days. The failure to adequately inform Plaintiffs of the length of the blackouts prevented them from properly preparing for the lack of power, or leaving the area. Accurate information might have saved Cristian Pineda's young life," the lawsuit alleged.

The Pinedas were without power and heat for two days and during that time temperatures plummeted to as low as 10 degrees in their area, the lawsuit states.

Instead of informing customers, like the Pinedas, that the rolling blackouts would be prolonged, ERCOT sent out messages on social media for customers not to do laundry on Valentine's Day and to "unplug the fancy new appliances you bought during the pandemic and only used once," according to the lawsuit, which included an image of ERCOT's Valentine's Day social media post

OK, Fuck ERCOT. Imagine seeing downtown Houston lit up while you froze to death in your trailer.

actually im not american and thought it was degrees celcius, their news are so dumb they report 12 degrees as if there was only faranheit lmfao, so yeah below feezing temperature could be hypothermia

Are you serious? When you're suffering from hypothermia you don't feel the cold anymore, especially while you're asleep. You basically fall into a coma.

I see how you could interpret that. But have you ever gone camping when it's cold? A tent is way more drafty and less insulated than a house. Imagine being in a house with blankets and loved ones and still dying. It doesn't make sense.

first you assume had a car. You might as well have replied they should have just gone to their country house or they should have just used the fireplace and their library or something like that.

then you assumed the car is in an open air garage. If its in a closed garage the exhaust fumes would have killed them.

third you assumed they knew the kid would that even though he had a blanket.

No. A friend of mine, who took his cars seriously, was waiting for someone on a frigid day in a large open parking lot and asphyxiated. As in he died.

I mention that he took his cars seriously so that it is clear that the vehicle was in excellent condition. Factor in that a Texas car is not going to be calibrated for the weather that they are having.

Instructions for waiting in a running car always say step outside every 15 minutes or just keep a window rolled down. And do not run a car indoors unless you have one of those exhaust mechanisms.

He was outside playing in the snow before. Its possible he got wet and cold and his body temperature did not go up enough by going into a cold house after and sleeping under a few blankets. I wouldnt be surprised if he didnt have proper snow gear. Probably just jeans and a hoodie. Its a combination of failure from the government and failure from the parents for letting him play outside when they had no power.

On the highway at "55" m/hr (100k/hr) there is a 55m/hr wind going past your car. People have asphyxiated in grid lock but you can be revived because peeps will notify authorities to get vehicle out of the way.

Holy shit this is a bad take @SPE . First all of all, Im pretty fucking left leaning. Ive never been accused of of shilling for the GOP irl or on this site. Second of all, even low income households typical have atleast one car in the family. How are going to compare the ownership of say, a 1995 Honda Civic to that of a country house? How incredibly out of touch with reality do you have to be to make that absurd comparison?

And if you could fucking read, I said outside of a garage not an open garage. Obviously I pointed this out before anyone jumped on my post and said hurr durr you can die by asphyxiation yet you still found a found to do so.

What is your angle here anyway? Yes the circumstances were shitty and the state failed their citizens in the worst way, but those are objectively the circumstances this family and many others had to face. Im not putting full blame on the family here. But what I am saying is if I were in their position, I wouldnt let my kids sleep until I can be assured that theyre not going to die of fucking hypothermia in their sleep. That means staying awake until I can build a fire, or find another person or family with any tools that can be used as a heat source (blankets, wood, matches, lighters, lighter fluid, etc). Maybe the family did all these things who knows. But when state leaders drop the ball and you have to fend for yourself and your family, you have to use your survival instincts, you cant just give up and sleep in the cold.
