Do you think this kind of stupidity deserves a long prison sentence?


26 y/o Shea Harkins from Florida fatally shoots his BEST FRIEND, Sean Cook while showing off his gun to him and in a sarcastic manner started to POINT it at him..where Sean then asks "What are you gonna do, shoot me?"..and while ironically playing CALL OF DUTY on XBOX One!!

Shea jokingly POINTS it at him and PULLS the trigger not knowing that a SINGLE BULLET was still inside...Sean was instantly killed from a gunshot to the chest.

He is now charged with one count of manslaughter following the incident

His best friend had arrived to his home to play video games that night at 7:49pm as Harkins went out of the room to show off his Colt M4 Rifle that he just customized before Cook arrived.

Harkins told police he had jokingly pointed the rifle at him just as Cook asked his final question that night to him before Shea stupidly presses the trigger..

Shea admitted to pulling the trigger thinking it wasn't loaded as first responders arrived to take Cook to hospital where was pronounced dead exactly ONE HOUR after he was shot at 8:55pm.

Harkins was arrested at 2am and was released on 10k bond..

Do you think this kind of stupidity deserves a long prison sentence?

Sounds like pretty textbook manslaughter. A longer prison sentence than is typical for that likely wouldn't accomplish much, and I expect he'll get exactly that. There's room to argue that he shouldn't be allowed to own a gun anymore, but there's also room to argue that the death of his friend as a clear consequence of his carelessness is enough of a safety lesson to make such restrictions unnecessary, and in fact he may swear off guns of his own accord out of guilt.

In any case, the dude lost his best friend and will be spending no small amount of time in prison.

I don't think his life necessarily needs to be completely ruined over this incident.

I would guess because this sort of incident is too uncommon to warrant the added mechanical complexity that would entail, but it's just as likely because people view accidents like this as being purely a product of stupidity and therefore resist the idea of implementing engineering-level controls to prevent them.

It's easy to unload a gun in the wrong order and leave a round in the chamber, then go about your business thinking the gun is safe. I didn't say 'smart', I said easy.

"Magazine Safety" where the gun will not fire without a magazine is a common but not universal feature. Not everyone appreciates mag safety. Some people want the option to fire the last round in the chamber in the middle of switching magazines. It wouldn't have saved this guy if Dumbass had an empty magazine in there, but it might have if the mag was out and he thought it was fully unloaded.

An accident born of stupidity, sure he might feel guilty for what he did, but he should still face some jail time simply for mishandling a firearm, you should never point it at someone (or anything for that matter) unless your intent is to shoot.

This is coming from experience of being in the same position his friend was in only difference is it was my brother aiming a gun at me, I told him he better not fucking shoot at me because it could be loaded (which he said wasn't) he then aimed at the wall and fired, it was still loaded.

So yeah whenever I hear of people feeling guilty for their actions of causing injury, or death of another through stupid actions like this I feel no sympathy for them, they should be punished accordingly. Ignorance, and stupidity shouldn't mean a slap on the wrist.

Now matter how horrible this idiot's life must be now that he's become the reason why his best friend is dead, letting him off on pity sets a standard that can be abused to deadly effect by people wanting to get away with murder, in addition to devaluing the importance of the responsibility and accountability.

One thing I can think of that will serve as punishment as well as being beneficial is to make him do awareness lectures for kids at school. Even though it should be common sense not to point your gun at someone which is something we're seeing more and more of. Maybe with him forced to tell his story as well as the effect it has had on his life to kids it could potentially save another in the future.
