So, as some of you know, I use to work and live in China until recently.

Due to the covid situation, I have lost literally everything. My contract ended a few days ago. At the end of my contract I'm supposed to get a bonus and a round trip flight wherever I want. I contacted him the other day requesting it. Explained the situation and said I needed it. He told me he had to figure out some deductions before paying it out.

He messaged me last night telling me some of the deductions. First one was for a months rent (May 15th to to June 15th). The problem with that is my apartment contract ended on May 15th. He told me before the 15th that he wasn't keeping my job for me. All of my stuff was sold or given away before the 15th. I don't think that's fair at all. He is also charging me a cleaning fee even though I had to thoroughly clean all 3 of my apartments in China before moving into them because of how much of a mess they were left in and was never compensated for my time. He hasn't messaged me since then to tell me the amount he is going to pay out.

I've decided that if he does deduct me for these fees and doesn't pay out my flight allowance, I am going to report him to the labour bureau. I have physical proof of him committing fraud, bribing police, etc. He created a fake business so that he could get me and eventually 2 other foreigners work permits. In China you need a degree to teach which none of us had. He created the fake business with us a partial owners so that he can trick immigration into giving us visas. He has bribed local police to get them to warn him if the education department is checking in so that he can remove our teacher profiles and have us leave the building during the inspection.

I also have a 1400 word letter typed out that I will share with all my Wechat groups. I have 19 groups and they account for about 150 students. The parents are all in these groups so they can contact the teachers for any reason. I will share this letter with them all. It'll be in English but luckily Wechat translates everything to Chinese. It explains everything that's happening and what he is doing (it's more than just falsifying documents for visas).

When I do get paid, if he deducts anything I will give him a choice. Pay me the rest of what I'm owed (complete bonus + flight allowance) or I report you to the labour and education bureaus, and I'll send the letter to all the parents.

What do y'all think?

Tl;dr: boss looks to be fucking me on my bonus and flight allowance that are guaranteed in my contract. I have proof that can seriously damage his business and possibly get him arrested. If he doesn't pay me then I will report.

Oh and this is my favourite paragraph from the letter. This alone will make parents extremely angry.

"If he lies to his employees, remember that means he lies to you as well. Do you remember Darious, the native English teacher from the UK? Yea, he was actually from Poland and never had a UK passport or a Masters Degree like advertised. Boss claimed he was British because it would trick parents into signing up their children for classes. He has gone around telling all of you that I had a bachelor's degree. Guess what, I don't. I only have my high school diploma. Do you know how he got a work visa? By creating a fake business with me as part owner, bribing a few police officers and falsifying documents. Like I said, he will happily lie to whoever he needs to if it benefits himself. "

Keep in mind this is China and this is all in accordance to Chinese laws. It could be entirely different over there, which is why I have no comment on this. In America, yes he's blackmailing and incriminating himself. In China this could be perfectly fine. I don't know.

You might drive someone to insanity or put them in a desperate situation where they will feel the need to retaliate in some way or some form.

I actually didn't find out about all of it to almost a year later. He actually used my signature from the teaching contract (took the last page of the contract and added it to the "fake" contact) without my knowledge. I only found out because he needed me to sign a document relating to the fake business so that he could add another person to it. Before I came he told me he could get me a management visa due to my experience which would allow me teach still, that turned out not to work.

I have no intentions of ever returning to China, so I'm not concerned if incriminating myself will cause a problem for me there. It's not like Canada will ever extradite a citizen to China.

I'm pretty certain that if he is your employer, he would at least has your basic information (address, banking info/payment methods, phone number) thus the sources available to your boss would make it easy for your boss to find you (assuming he is smart and resourceful).

He has none of that. Only document of mine with any personal info on it is my passport. That doesn't contain my address or anything like that. I was paid via alipay so no bank accounts were used. Only information he has is my name and birthday.

It's not technically blackmail, he's not threatening any crimes against the guy for whatever he wants, nor is he asking for anything he isn't entitled to.

I may not like TC but I also know he's the type who would actually care about these finer detail in his contract.

Only real risk is that he might get summons for crimes he committed, and I have no idea if China would try and extradite him.

Luckily Canada doesn't have an extradition treaty with China. So even if what I did could be technically considered a crime, it's not like they can pursue it.

Going to court would be impossible. Foreigners NEVER win lawsuits in China. There are cases of foreigners being obviously scammed and then the foreigner is thrown into jail. See the link below for one of many examples. Foreigners have no rights in China and courts will always rule in favour of the Chinese national.

He does have some but it's at a local level only. He has a couple local police in his pocket but that's about it. The education bureau would definitely investigate it. The one thing China is cracking down on is illegal teachers (majority of them are working on business or student visas) and every day you hear about a school getting a surprise visit from the education bureau and then multiple foreigners end up being deported while the school owner receives extremely large fines for each illegal worker.
