But places won't hire her just because she shakes. Like she does technical interviews and they go well and the places love her, but they say straight-up they won't hire her because of the shaking, even though she does great services.

Now she wants to get an employment lawyer because she considers it a disability. I just don't know if that's a legal reason for declining to employ someone. Anyone know anything about that subject?

Idk /blogfaqs.

Wouldn't someone need a steady hand to do cosmetology? I don't see how someone could do that job if they shake all the time.

She honestly may have a case, especially if she can present documented disability or medical disorder as well as competence.

She finds ways to work around it successfully.

I mean she was able to pass the state board practical exams and received the top academic excellence award from her graduating class. And she definitely has documented history of the tremors, but idk if it's ever been formally called a "disability"

Yeah, this sounds like an ADA violation. I'd look more into it.

Disability might be a strong word.

Just a documented medical disorder.

If nothing else you can go in for a consultation with a lawyer to see if there's a case there.

I legit thought it was a Blu-Ray boxset of the films on entering this topic.

a lot of companies discriminate against disabled people, for example with the "must be able to lift up to 25lbs" requirement you'll see randomly on job postings.

i am not a lawyer but it sounds like kind of a grey area, you'd have to actively prove that they didnt hire her based on discrimination & not because they didnt like her experience or personality or w/e.

is there any kind of medication she can take for her condition, even just short term for interviews?

Sounds like an ADA violations unless not having tremors is a bona fide requirement of the job. Given what you said about her training and education, it doesnt sound like its a bona fide requirement.

Tbh, a box set of the essential Tremors would only be the first one anyway

She just had a company tell her they liked her and her work, and the tremor was the only reason they didn't hire her. And she actually was hired by someone else, but the owner started asking her who her neurologist is, and what medications she's taking for it. Then he told her they wouldn't be a good fit because of the shaking and she quit.

She's currently on Primidone, and it helps, but she still shakes.

This. Not having tremors might be a bfoq in the abstract, but it's hard to prove that's true it she is licensed

If she was able to do the work to get licensed then that means shes fully capable of doing the job, right? Like the licensing test is do these things that you have to do, isnt it?

Definitely seems like an ADA violation
yep. she was waived from having to do eyelash extensions though, due to her tremors.

That's a tough one but consider another scenario. Imagine of someone had a verbal tourettes and they shout random things constantly. Now imagine that this person goy into law school and passing the bar. Do you think you would hire that lawyer to represent you, or your company in the court of law?

And that's assuming firms even take them on as an associate. It's tough but she may need to look at other work.

doing make-up
surgeon
shave and a haircut
tattoo artist

I feel like these all require a steady hand

but i mean if she does great service, can't she just open her own business up? I know plenty of chicks that went to cosmetology school that run their own biz...they lease a chair out from a place, but the places don't seem to really care as they're just collecting rent.

It might be against rules where you could get a lawyer, I'm not sure about this at all. But, if she can become a huge youtuber for doing makeup and such with essential tremors, I'm sure she would be a huge inspiration to others just like her.

Sorry don't have any really good advice, but your a good poster and I wanted to at least try for you. Hope you been well drpoop!

That's the thing, even if she is great at the job people won't want to work with her because of a fear of being hurt.

She cut herself less than her friends did, and she had some of the highest pre-book rate in her class (when a client rebooks with you after their services are done before they leave)

lol sorry i hurt your feelings. I'm not risking a stranger going near my skull with sharp objects and a known, to her at least, (i assume she won't outright tell her customers) tremor. Hope you feel better little buddy.
