All nations unilaterally determine their standard time zones, applicable only on land and adjacent territorial waters. The date line can be called de factosince it is not based on international law, but on national laws. These national zones do not extend into international waters.

Countries near the line can & do adjust their timezones for political as well as marketing purposes. In 1999, a few island nations in the UTC -11 and -12 timezones changed to +12 and +13 so they could claim to be the earliest to enter 2000. It worked, and tourism got a boost in exotic places like Christmas Island and Pago Pago.

Right now, Hawaii is the last major population center to celebrate New Year's, followed by LA/SF/Seattle. If these places could adjust their time zones to UTC+14 and +15 respectively, and so on, up to +18 for Eastern Time, the US would be the first major country to celebrate New Year's. This would help increase tourism, which means more money to support local businesses as well as governments.
