NEW YORK ON MONDAY passed a controversial bill that will allow immigrants in the country without legal status to obtain driver's licenses, making it the 13th state to have such a law on the books.

The so-called Green Light bill has for months been met with fierce resistance from Republicans and has split the state's Democrats, catalysing a debate over illegal immigration and immigrant rights.

The measure, which was approved by the state Assembly last week, passed the Senate Monday by a vote of 33 to 29 and was signed into law by Democratic Gov. Andrew Cuomo later in the day. The state's scheduled legislative session ends Wednesday.

Progressives in the state have pushed hard for the bill's passage but have encountered intense pushback from Republicans as well as Democrats who represent swing districts, in particular those in Long Island. Proponents say the measure will make the roads safer, drive down the cost of car insurance and generate revenue for the state. Opponents, however, say the measure will encourage illegal immigration and undermine the law.

Public opinion is divided on the measure. A Siena College Research Institute poll conducted earlier this month found a slim majority of New Yorkers opposed the driver's license bill, while about 40 percent backed it.

The measure's fate was uncertain for weeks and it appeared to be stalled as recently as last week, when the leader of the state Democratic Party, concerned about the political ramifications, urged suburban state senators not to back it, according to The New York Times. Republicans have already indicated they will make the measure a central issue during next year's elections.

Cuomo, who has said he is a staunch supporter of the bill, on Monday surprised lawmakers and said he would only sign it if the state solicitor general felt there were enough protections to prevent federal immigration authorities from accessing immigrants' data through the DMV database. Attorney General Letitia James released a statement Monday night saying the measure contained "ample protections for those who apply for driver's licenses."

The measure will impact some 940,000 immigrants in the country illegally who live in New York, according to an estimate from the non-profit Migration Policy Institute.

The fight over driver's licenses stretches over the better part of two decades. Before 2001, driver's license applicants in the state were not required to prove citizenship. In the wake of the Sept. 11 terrorist attacks, then-Gov. George Pataki, a Republican, issued an order that required license applicants to have a social security number.

In 2007, Democratic Gov. Eliot Spitzer said he would undo the policy, only to be met with fierce backlash that prompted him to abandon his promise.

In fact, this makes them more expendable as owners will be throwing them behind the wheels of vehicles. All the while no reporting of taxes.

States don't have jurisdiction over immigration, but they do have jurisdiction over their own roadways.
At best, the only thing a state can really do is forward the information on to ICE. Assuming, of course, the address given for the drivers license isn't bullshit.

Because being in the country undocumented isn't an offense that demands deportation, especially if they are awaiting asylum hearings.

And I'm all about upgrading and fixing the asylum procedure and increasing the judges and courts in the states to try and fix this issue, but unfortunately the current President and his administration seemingly don't give a single fuck about that. Almost as if they are using illegal migration as a campaign strategy and actually root for more illegal migrants to come in or something...

Heres where we get to important legal point #1: being undocumented is not a crime. Its a civil violation. Undocumented immigrants have rights under the U.S. Constitution. And according to due process, the police cannot detain anyone who hasnt at least been suspected of a crime. If a police officer encounters someone walking down the street who turns out to be undocumented, they cannot arrest that person because that person has not committed a crime (ICE, however, can). Similarly, if the police arrest someone undocumented for example, someone suspected of committing a crime, who is then cleared, they must let that person go.

Important legal point #2: holding an immigrant past the point when they should be released, just so that ICE can pick them up, is unconstitutional. Multiple courts have said so, and immigrants can sue the police for unlawful holding.

Here we get back to the point of sanctuary cities: in a sanctuary city, the police will release an arrested immigrant after hes been cleared of charges, posted bail, or completed jail time for whatever he was arrested for. A non-sanctuary city will hold that person until ICE can come pick them up even though that extra holding is not constitutional.

Keep in mind that all of the above only applies if the undocumented person has not committed any serious crimes. If they have, the police can keep them in jail by filing charges. Or ICE can present the police with a warrant or other order from a judge, which will result in a hold until ICE can come by.

Asylum claims are made at ports of entries (or embassies); not by sneaking across the border, disappearing, and then making a claim when caught.

Also, hard for that blame, about Trump's Admin not doing anything, to mean anything when you consider his predecessors have barely done anything as well.

This. The dehumanizing tactics of the Trump administration are appalling, but at the same time, I don't understand why people living in the country illegally need more free things. It's illogical, and it's a slap in the face to every person who worked hard and came here lawfully.
