The mother of a 1-year-old boy found dead of a drug overdose in their Bronx apartment five months ago was charged with the childs murder, police said Wednesday. Daira Santana-Gonzales, 23, was accused of killing her son Darwin in their University Place home just two days after Christmas 2018, when she discovered the unresponsive child in an apartment used to package heroin, cocaine and fentanyl, authorities said. The infant died a short time later at St. Barnabas Hospital. The adorable, dark-haired boy somehow ingested the toxic mix of drugs wafting through the apartment. His death was ruled a homicide in March after an autopsy turned up the narcotics in little Darwins system. Santana-Gonzales was indicted and imprisoned on drug charges in January, weeks after cops raided her apartment in the aftermath of the babys death. She is currently behind bars on Rikers Island, held in the drug case on $250,000 bail. The Bronx district attorneys office declined additional comment on the murder charge. Santana-Gonzalez is due for a June 6 court hearing in the drug possession case.

Her estranged husband Antonio Modesto Gonzalez, who disappeared after his sons death, remained on the run Wednesday. Police discovered a wad of cash hidden in his closet, along with empty envelopes used to package drugs and a significant amount" of drugs left inside the apartment. A security video captured Gonzalezs cousin carrying two suitcases out of the apartment, although the contents were never identified. Her husband and his cousin were in the apartment on Dec. 27 when she arrived home at 4:30 a.m. after a 13-hour shift at a local restaurant/club. When she awoke at 10 a.m., little Darwin was lying in his bed and had stopped breathing. Santana-Gonzalez and her husband rushed the infant downstairs and flagged down a cab and then a passing police car as they sped toward the hospital. When Santana-Gonzalez returned to the apartment, her husband was already in the wind, she told the News. Antonio Modesto Gonzalez was named in the same Jan. 23 indictment as his wife, charged with a dozen counts of criminal possession of a controlled substance.

Seems appropriate, but I think it will be hard to prove. Mainly because they will have to be able to prove that the parents gave him heroin, not just make the (entirely reasonable) assumption based on them selling it and him having it in his system.

Murder 2nd degree is an open/shut.

You can't just leave heroin around kids like that and reasonably think it's safe.

nope, it being an accident won't help her because they most likely just had it lying around the house
