longtime Utah Judge, Michael Kwan was SUSPENDED WITHOUT PAY for 6 MONTHS after he made comments online about President Trump, including one bashing his "inability to govern and political incompetence"!!

He made the posts on FB and Linkeln in 2016-2018 that violated the judicial code of conduct and diminished the "reputation of our entire judiciary" wrote State Supreme Court Justice John A. Pearce

His post was private but could have been shared by friends as Pearce said his behaviour denigrates his reputation as an impartial, independent, dignified and courteous jurist

Kwan has been a court judge in Salt Lake City since 1998 as he deals with misdemeanor cases, violations of ordiances and small claims.

He was appointed by elected city officials to a 6 year term and retained his position by voters

He said his suspension wa inappropriate and an unlawful attempt to regulate his constitutionally protected speech

His Attorney, Greg Skordas said the judge is disappointed by the decision but accepted he would get some reprimand

Like many in 2016, he felt strongly about the results and said things in "haste" but acknowledges he is held to a higher standard

Taylorsville officials agree with the punishment and expect him to return to the bench when the suspension ends.

His political offiliation has been sealed but he has been critical of both parties in the past

On Inauguration Day of Trump, he wrote "Welcome to governing. Will you dig your heels in and spend the next four years undermining our country's reputation and standing in the world?...Will you continue to demonstrate your inability to govern and political incompetence? Welcome to the beginning of the fascist takeover..We need to be diligent in questioning Congressional Republicans if they are going to be the American Reichstag and refuse to stand up for the Constitution"

The ruling suspending Kwan also cited an interaction in court with a defendant in which he criticized Trump after the defendant said he would use his tax refund to pay fines and Kwan says "You do realize that we have a new president, and you think we are getting money back?"

The defendant says he "hopes. I pray and i cross my fingers". Kwan responds "OK. Prayer might be the answer cause he just signed an order to start building the wall and he has no money to do that. But don't worry, there is a tax cut for the wealthy so if you make over 500,000 you're getting a tax cut"

Kwan received a reward for reducing drug and alcohol abuse and served on the Utah Judicial Council and is president of the Chinese Railroad Workers Descendants Association

If it was just his FB post, I'd think 6 months is a little harsh. But when you start injecting your political opinions in court, in front of a defendant, speaking about a topic that isn't political, you come across as kind of unhinged.

Supreme Court justices discuss court fines and demean defendants? Do they also yell at clerks that got a promotion without their knowledge and threaten to fire them like Kwan did?

What exactly is he suspended for? Even if he was hearing a case on Trump you just bump the case to another judge, you don't suspend the guy for no reason.
