Poll of the Day > So, a quick update about my friend in jail...

Before I begin you guys might have a lot of questions. I may or may not answer them. likely not. anyways...

for those who dont know, without me going into a bunch of detail because I will be purposefully vague here, one of my best friends is currently in jail under accusations of child molestation. I'm not going into a super amount of detail about it. What my view is now, as it has been for the past few months is that he did NOT do the alleged crimes. I base this off of nothing official, he has not been sentenced or proven guilty(or not) in any way yet. But I have talked with him extensively on the phone, and a family friend had contact to more police documents/lawyer stuff than I did, so there's that as well. i don't base this off of our friendship, or feelings. Just the facts ive been presented thusfar. I've seen zero evidence to this point saying he did it.

Now to the quick update: I finally get to do something(small, perhaps not even important) about it.

Back in september he told me a story where at one of his court visits he overheard a clerk of the judge mention how my friend was guilty because of "how he looked" as in you know people see a sex offenders mugshot and go "well duhh look at the guy" based off of nothing but appearance. He is filing a motion to have her recuse herself or be recused from the trial due to personal bias. and indeed googling her name the very first result is a superior court forcing her to be removed from a trial involving the re-sentencing of a sex offender. Not that this proves this story of my friend's happened, but it obviously wouldn't be out of left field. its as if her remark took a facebook comment about pedophiles(and ive seen em all at this point) and made it her official stance on the matter.

So, anyways, I've been tasked with writing a letter stating that my friend did in fact tell me this story in hopes she can be recused. I am not making any other comments other than telling a brief story about his story, saying this shows bias, and to be recused. no comments about anything else, because my opinion otherwise is irrelevant.

So by doing this I feel I am helping the situation in a small way. If that story happened, she doesn't really seem fit to oversee this trial. they could at least look into it.

He said he had no proof. But this is something thats been going on a while. There were a bunch of other things that we knew from earlier. Based on what he knows from everything that happened, he made an informed decision... Thats all.

I don't know definitively...but for a variety of reasons it seems highly unlikely based off of things ive been told and facts ive heard. I have yet to see a single shard of evidence. everywhere the police look, they find nothing.

Can't rule out the other end though, it just doesnt seem plausible.

Lots of reasons. Often times the accuser is usually very petty and just doesn't like the guy. A family member of mine tried to do this same shit to a guy and would coach her grand-daughter to say some heinous shit. She even admitted to many people (including me) her story was a complete lie. That she just wanted him to suffer. Basically he had been dating the girl's mother, who ended up cheating, so when he broke things off the family came up with this plot to "make him pay" for breaking her heart or something to that effect.

Eventually me and some other family members took this info to court and testified in his favor, and the girl who was allegedly molested even admitted that her elders had all put her up to saying all of the terrible things.
The grandmother is dead now, probably in hell if you believe in that.

Believing the accuser without any kind of proof is bullshit. You can't trust anything but evidence.

I cut ties with that part of my family since then. Fuck people who do that shit.

[Edit] The girl ended up having to spend some years in foster care after the whole ordeal and apologized to the man after she grew up and realized that her family almost ruined his life.

I know the feeling tc. Ex friend of mine almost went down for rape. Guy was a bit creepy and creepy looking to boot but it turned out it was a case of both being drunk and she regretted it the next morning. He probably would have went down if the girls best friend didn't straight up tell the police she was lying her ass off and that she had been with them the whole night (even had been in the room when they had sex apparently)

Not sure what you think a letter from a third-party confirming hearsay will accomplish but if you don't think your buddy is guilty, go for it and best of luck.

No idea one way or the other but other than talking to the kid what kind of evidence could police even find if the allegation even is true?

Well at the very least examining the recorded phone calls would show he told me the story back in september and he isnt coaching me on what to say. I dont expect this to prove anything, but perhaps they will take a look into this judge and see she is unfit for trail, as I posted in the OP she has just been removed from a different sex offender case due to biases. So, I dont know. but this is my first chance to actually try and help my friend. All ive done so far is make visits and accept phone calls. Which he really does appreciate.

To me this whole thing sounds bogus, and i havent been given a reason or even an inkling to think he's in any way guilty thusfar. None of his main friends have jumped ship and they all are on this same page, too. My mom as well. I cant speak for others as ive only spoken to certain people, but he has a lot of support.

My thoughts are though that even if he did it, the friendship wouldnt be the same. but my attitude used to be that i'd cut him off, but now im thinking I should still be there to support him and make sure he gets the help he'd need, though the friendship wouldnt be the same. But....while I am not 100% certain of his innocence, im not even super upset or nervous because I dont feel like I have to question my friends ethics and morals, as to this point I havent seen a single shard of evidence backing up the claims against him.

At this point, according to him....his first trial was postponed. His next trial is set for march but from what he tells me if nothing changes he has to be let go on a house arrest type situation in january...so likely he will be out of jail at least but not legally off the hook. if this keeps going on until may with no resolution he tells me he is free to go after that. We'll see, though.

So who did he piss off so bad to be falsely accused? I mean what's his story for why he's being accused of something he didnt do?

His contact with this child was via babysitting. He previously did not know this family.

As for why they could be making false claims/coaching their kid...I dont know. thats a mystery I may never get an answer to.

Hmmm... I believe in innocent until proven guilty but that doesn't sound good. Doesn't sound like the kind of scenario where people would often be falsely accused

Oh well. I know what I know and believe it because of facts ive been told. However my mind is open for anything to change but at this point if the trial was today(first one postponed) I honestly believe the only evidence the prosecution would have is a blank piece of note book paper.

Well, as has been said, it's kinda difficult and rare to have direct evidence of this sort of thing but if you know facts that you dont feel comfortable sharing then that might make a difference. But based solely on the scenario I can't think of a really particularly compelling reason someone would falsely accuse.

Well, hopefully, everything works out the way it should. I know you cant tell us everything. But keep us updated with stuff when you can.

I;ll probably post more when his actual trial finishes. if he is ever eligible for house arrest i already told him he could room here. thats how strongly i feel.
