This more or less confirms 0 Custom Robo content (even music/trophies) in Smash Ultimate.

They recently renewed trademarks for some of their obscure/dead series, and the speculation is that it's for Smash content.

No because copyright and trademark aren't the same thing.

Copyright isn't what stops someone from making another Custom Robo game. Copyright is what stops someone from porting an existing Custom Robo game and selling it as their own, even if they call it something other than 'Custom Robo.'

That said I am unclear on the status of Custom Robo's IP and whether or not Nintendo still owns it if they're not keeping the trademark. I have no idea what happens when a video game company decides not to keep a trademark? first time I've ever heard of it.

But like the way I understand it, if Custom Robo's not trademarked, then yes you absolutely CAN make your own Custom Robo game
