Republicans have quietly imposed a new tax on churches, synagogues and other nonprofits, a little-noticed and surprising change that could cost some groups tens of thousands of dollars.

Their recent tax-code rewrite requires churches, hospitals, colleges, orchestras and other historically tax-exempt organizations to begin paying a 21 percent tax on some types of fringe benefits they provide their employees.

That could force thousands of groups that have long had little contact with the IRS to suddenly begin filing returns and paying taxes for the first time.

Many organizations are stunned to learn of the tax part of a broader Republican effort to strip the code of tax breaks for employee benefits like parking and meals and say it will be a significant financial and administrative burden.

It looks like certain benefits which are now nondeductible for all business, will be taxable for exempt entities now. Like parking (which is a dumb part of tax reform IMO).

Honestly this seems like a logical extension of the Tax Cuts and Jobs Act (which itself is not very logical). If businesses can no longer pay for certain fringe benefits and deduct them as an expense, it makes sense that not-for-profits wouldn't be able to either. You can't target only certain types of exempt organizations with this.

The way these not-for-profits can avoid the tax is to pass it on to their employees. Include the cost in their gross wages, so the employee pays more taxes. Many businesses are doing this already. But parking is a tricky one if the employer owns the parking lot.

Per current IRS rules, parking is a De minimis fringe benefit if paid in excess of $255 a month to the employee and deductible to the employer. It does not state if the excess of parking paid by employer is included to the employee or if the total amount. One would then have to determine what the value of parking is, especially if the parking lot is owned by the tax exempt organization.
