If a co-conspirator kills someone in the process of a felony, then everyone involved can be charged with the murder.

It was the cop that killed. The cop shot a friend of this kid's. And he's being charged with that cop's action. It's a fucked up law that lets a cop pass off their action onto a crimal and blame them for it


Im fine with that too.

Its the offenders fault that there was a shootout to begin with.

He should not have been tried as an adult given the circumstances. He did not pull the trigger and was under the influence of actual adults. That's usually mitigating.

Hes not a victim of anything but his own stupidity. I knew right and wrong at 15 and wouldnt have been stupid enough to take part in burglaries. He certainly shouldnt be set free. His sentence is very extreme though but his behavior shows he probably deserves it.

The only issue I have here is how is his friend shooting at the cop resulting in the cop firing back and killing said friend a murder charge for them? That really is a miscarriage of justice, piece of garbage or not.

The article says 'several' in the group shot at cops, including the dead guy.

I don't buy the idea that this kid wasn't.

Smith is the man on trial. Washington is the dead man. Washington ran towards a cop who shot him with a .38. I don't see where it says Smith was armed or shot at anyone. If Washington charges a cop who kills him, what did Smith do to deserve a murder conviction?

There were 5 kids. How many were shooting at cops? It says 'several.'

I don't buy that this kid was the ONLY ONE not shooting at cops, and I doubt the jury bought that, either.

it was only 1 kid. 4 25 year olds and 1 15 year old that was dragged along

so if a 10 year old snuck into an abandoned house to play and at the same time, someone killed someone, you would arrest the 10 year old?

That doesn't mean he was forced. Literally nothing suggests he was anything more than a totally willing accomplice

Thus his conviction.

So, in reading the article:
- part of a group who commotted robbery
- one of the group shot at police and was killed for it
- guy was charged for the death of his friend as an accomplice to the events that led to his death

Im not surprised he avoided the plea deal. The sentencing seems excessive and possibly racially motivated, at least, the legislation that made it possible.

Except in this case, he wasn't 10.
He didn't sneak into an abandoned house.
He didn't play in said house.
Stop coming up with "what if's" scenarios and deal with the fact that he's guilty of helping commit a crime and got judged as such.
