Context is important. If they're actually sending classified information, then yeah that's a massive issue. If they're talking about personal and private issues, then I don't see the problem.

There is no indication that Kushner has shared any sensitive or classified material on his private account, or that he relies on his private email account more than his official White House account to conduct government business. Aides say he prefers to call or text over using email.

To be fair, there's not really a precedent until a judge higher than a trial judge makes a ruling. Comey and Lynch being a corrupt lackeys doesn't really carry water in legal precedents.

At the moment, no, there isn't. That can change as facts emerge. Simply having a gmail doesn't mean they're sending confidential information or sensitive government information. That is the major and key difference between this and the Hillary email scandal.

Over sixty-percent of the 2015-2016 presidential campaign news coverage was devoted to emails, private servers, and Hillary Clinton's usage of them. From those priorities alone we can assume the continued use of private email servers by white house officials, some of whom actually are under investigation for potential criminal dealings with foreign powers and obstruction of justice, is deserving of every bit as much attention and bombast.

You don't want to undersell this. You'll be hearing about this for the next seventeen months.

It's even more complicated. As those emails were being reviewed, different intelligence agencies had differing opinions on what should or shouldn't be classified based on how they got the information.

If you were a more secretive intel agency, any information you received from a sensitive and protected source would be classified to protect the identity of the informant. If another less secretive agency were to independently acquire the same information in the course of an investigation that didn't potentially compromise an asset, they would rightfully leave them unclassified. In the case of Clinton's emails, the emails being contained information that had the feuding intelligence agencies retroactively classifying or declassifying documents because they disagreed with how the other agency was handling their information.

TLDR: Some of those items were well-circulated well before the investigation got their content reviewed and some of these agencies decided they should be privileged information.

This apparently comes up a lot anytime a former intelligence agent or high-level state official writes a memoir and wants to include a memo or letter. There have been attempts (or just gut reactions, really) to reclassify letters and memos years after they'd already been published to the general public.

There are serious communication issues here. Thing is, that's kind of by design.

Right, I know that some things are classified in some sources after being published unclassified in others.

There's also the fact that some of the emails in question were improperly classified, in that they contained classified information but didn't properly add the classification banners at the top and bottom of the email.
