Which would suggest firing a missile over a country is the same as firing it at it.

They're still technically at war with South Korea.

Doesn't matter when they have a gun at SK's and Japan's heads.

That's correct.

The question isn't if it's legal though, it's what anyone is going to do about it, which is questionable.

I'm honestly not sure if it is sovereign beyond a certain point. Keep in mind that only a certain number of miles from a nation's coast are considered sovereign and I half assume that the same principle applies to air space.

Wiki'd it and I seem to be correct in that assumption, although it's a little unclear how far up that extends

Not really. Half the world has at least one country separating it from its intended target. However, it's not declaring war on all of those countries in-between every time a missile is fired.

Air sovereignty is the fundamental right of a sovereign state to regulate the use of its airspace and enforce its own aviation law - in extremis by the use of fighter aircraft.

Airspace immediately above the land and water areas are vested with title to the underlying soils (see United States v. Causby 328 U.S. 256, 266 (1946)). Altitudes above 500 ft over private lands and all the airspace above public lands forms part of the sovereign state area. Flights by some civil aircraft into the airspace of a UN member state does not need prior permission (Convention on International Civil Aviation).

The upper limit of national airspace is not defined by law.
