insurance covers the owners of the policy and the drivers of the vehicle.

if the insurance is under their name and the son lives in their home they will wind up being responsible for any excessive restitution. which means if they proceed on a civil case they can go after the parents house and money.

it's why my parents always made sure insurance was under my name.

if the insurance was under the son's name and its his policy they wouldn't be able to go after the parents.

Your cousin really fucked the pooch and I have no sympathy for him. I sympathize with the the family of the mother and unborn baby that aren't coming home. Honestly it would've been better if your cousin didn't make it, because his life is fucked for the rest of his life. He's gonna have a label on him and he's not gonna shake that. Honestly I sympathize with people if it's their first incident with DUI but after the first time I have a hard time feeling too much in a situation like this. I still feel for your family because I know how it feels. My own little brother is going down the same path. He's already had 1 dui that he got out of somehow, just rolled my mom's car and got away without getting in any trouble, and my family keeps bailing his ass out of trouble when he's gonna eventually kill someone like this. Ive already pretty much mentally prepared for it because I don't want to be one of those people who get caught up in the moment and can't take a step back to realize the shitty things the person you care about did.

I also have a good friend from high school who got fucked up with pills and did a bunch of zanex one night, long story short his girlfriend called the cops and he ended up shooting and killing the cop and they had an all night manhunt for him. I know he never would've done that before he got into drugs and shit, but people have to take responsibility for the shit they do when they're fucked up if they're going to be doing that kinda stuff. He's probably going to be getting the death penalty soon if his case doesn't get postponed again and I don't feel sorry for him too much. I know he feels like shit about it now but he made his bed just like your gf's cousin did

My thought is he probably gets 12 to 20 years and does 8-12.

It would depend on the state and lawyer but often charges will run concurrently and that's an easy one to plead for. I just don't know how much the weed would bone him. Lifes probably not over but a good chunk is gone.

Look at it from the driver's perspective. It is a tough habit to break once you start. You do it once, see that you can get away with it, and repeat. You begin wondering how people get caught.

This guy just happened to slip up in a big way. He now has to live with this mistake. How is that not significant enough punishment?

EDIT: I see that he had a prior DUI. That changes things a bit. The first one should have been a wake up call. I can understand the need for some jail time in this instance.

Because drink driving isn't a mistake. It is an active and willing act. Walk, get a taxi, get someone else to drive you or just don't drink.

If you drink and drive you deserve hefty punishments. Both to deter people doing it, and even more so if you actually do harm - such as ending people's life because you are a selfish moron.
