There was a story about the government just bombing Gothem because of how bad it was there and it only made things worse because somehow all the supervillians lived and spread out to other cities where it turns out they were easily able to beat other heroes and take control leading to world being forced into world war because Scarecrow spread fear toxin into the US government and Two Face leading the justice department

Batman is a detective and a hero. He has no powers and thus is not a superhero. That's probably what makes him so much better of a character than Superman and most of the others.

Joker is the only badguy that successfully pulls off insanity. Most of the ones that try to just come off as cold blooded murderers who don't give a shit. There's a massive difference. Joker is fucking nuts and I don't see how anyone in their right mind is capable of writing good material for his character. I'd imagine you'd have to be somewhat of a nut yourself to come up with it.

I used to think this but no, there are several unpowered characters that count. The distinction between a superhero and somebody like Robocop or Indiana Jones is more about common storytelling tropes than whether the character is actually superhuman.
