4 White Students in California are SUING their School District after they were Suspended for LIKING and COMMENTING a racist instagram picture of one of their peers and said it violates their students' free speech rights!!

They accused the Albany Unified School District for unjustly suspending them because the offensive posts they made were on a PRIVATE ACCOUNT that had no connection with any school activity or school account.

The posts were found on another suspended student's account that included NOOSES drawn around the necks of a black student AND their school coach.

Alan Beck, their attorney said "This to me is no different than having a private drawing book and making some offensive drawings at home and sharing them with a couple of friends. Does the school have the right to ruin my life over something i was doing at my house"

Legal experts said the Trump administration will be dragged into this as their lawsuit will present federal courts with another opportunity to decide how schools and regulate student free speech

It raises the question on whether "likes" on social media are treated as original osts as likes can be ambiguous which could be saying "This is funny, i agree with it. Or i don't agree with it but i want to stand up for your right to say it" said Eugene Volkh who teaches free speech.

That specific picture they were bumped out of school for was because it also included a picture of a black student at their school next to an Ape and jokes about their weight and looks.

Albany is an affluent community next to Berkeley which prides itself in liberalism and Political Correctness

Valerie Williams, the superintendent said they pride themselves in being an inclusive and respectful environment as they will take appropriate action

The original student who posted that image to his friends is also facing EXPULSION as his name is not being released

Students said that account was targeting "only black people" as the suspended students were outed by peers and were "publicly shamed" where they were cursed and jeered at.

A protest quickly formed after the incident was revealed back in late march where students and the community were outraged over the posts

The 4 want unspecified damages and a court order to remove their suspensions as one of them said it was their RIGHT to say whatever he wanted out of school time..

Yeah, I don't know if the school should suspend them for that. They're idiots, but I don't think a like warrants a suspension.

The kid that made the drawing? Absolutely should be suspended, at LEAST. Though I'd almost consider kicking the kid out, it's not fair to make the victim have to live with that guy around. But a like is too ambiguous, I've liked photos without even really looking at them. Are they stupid and need some minor punishment/talking to? Absolutely. but suspension is too much.

I don't like this comparison because you're forced to go to school by the government. Unless you're drafted into the military or at jury duty, the government never actually forces you to go work somewhere.

Why don't they? The school has an authority to act in case a student is caught making threatening gestures or writing harmful material against another student. What's the difference between that and liking a post that shows a student with a noose around his neck? It's also a threatening image towards another student,why should the school steer clear when his safety is being threatened?

you're not forced to go to school just like you're not forced to go to work. you can go and drop right out of school whenever you want as(legally at 16), just like you can stop working and die in a hole somewhere because you can't afford anything. People saying that it's fair are responding with emotion instead of logic. They're pieces of shit but they absolutely don't have the right to suspend them for liking the image. The kid who created the image can be punished because that would be considered a threat, and depending what the comments said could also be grounds for punishment. If a student only 'liked' an image though they're going to win that case.

I personally don't feel as if the school has the right to weigh in on their personal lives, but then again, the nature of the internet really blurs the line of what's personal & what's public. Though really, we all know that children don't possess any rights socially, beyond protections from abuse; it's why we can impose so many restrictions on their actions that would never fly against most other social demographics.

This is just using technology as an excuse. A private online account doesn't exist in its own little space in the world. They could've been on their smart phones in class liking the picture. They could've been in class or in the hall with the kid they targeted cracking up about an image of him being murdered.

Aside from that, and more importantly, the effects of what they did carry over into the school and can cause problems there. Imagine you go to school and see a kid who liked a picture of someone making threatening and racist images about you. That "like" is no longer just in cyber space. It's an expression of real world thoughts and feelings of a person passing you in the hall, sitting behind you in class, etc. I think of it as less about punishing the racist pieces of shit and more about standing up for and protecting the targeted kid, letting him know they have his safety in mind, keeping him safe from people who, regardless of the medium, condoned an image of him being killed.

One more key point, this more than likely did not start off of school grounds and is an extension of bullying or turmoil that started at the campus further giving them a right to punish them.

I tried saying this after getting in trouble for a fight that was off campus and had nothing to do with school. It didn't work >_>
