Would you press charges on a child (12 or under) who punched you?


10 y/o Autistic Boy, John Benji Haywood from Florida was ARRESTED for apparently PUNCHING his teacher SIX MONTHS AGO!!

He arrived at school to take a standardized test only to be HANDCUFFED and arrested by a police officer and hauled to the cop car!!

He was confused and sobbing as his mother, Luanne filmed her distraught son being handcuffed at Okeechobee Achievement Academy as she repeatedly asked why her son was being arrested.

He was suspended back in November 2016 for punching a member of the staff but had no idea that there was a warrant out for his arrest. He spent the night at juvenlie facility before released the next morning under house arrest

John cried and pleaded with school resource deputies not to touch him..a school report said he was suspended for punching and kicking a school employee who Luanne said was a 6'4 MAN who weighed 300lbs..

He was homebound for several months and returned to take a test but unbeknownst to them that the employee actually filed charges against him as an officer recognized the renegade boy and immediately handcuffed him and led him into a cop car

Luanne said "He has autism. He doesn't know what's going on, he's scared to death and he's a 10 years old"

The police said they were unaware the boy was autistic and said they would take it into account going forward..

John is accused of battery on a school employee and is charged with a 3rd degree felony who is scheduled to appear on May 11...

You know what's funny, recently I talked to a girl at work, her daughter had gotten punched in the face by another girl. The other girl was suspended, but the school refused to call the cops, they said that was not how they handled situations like that. The mom said fuck it, and went to the cops herself. She spoke to a cop and the cop told her, "when it comes to elementary and middle schools, as long as the child wasn't truly hurt, we call it "schoolyard violence" and do our best to not press charges."

He told her he would go down to the school and talk to the girl and put a scare into her.

Those girls were in seventh grade. Neither had autism.

This is in California, and obviously every state is different. But at the same time, this kid is ten years old. I could kill so many ten year olds if I wanted to.

Yes unless it was my own fault. Doesn't matter any disabilities the kid may have. Being as punching the kid back would get me into trouble more than the other person then getting the cops involved would be the best option. Just because it's a kid that doesn't mean it can get away with anything.

I used to lead scouts (~12yo) and I would never call the cops on one of them for hitting me. They're just children, they're zero threat unarmed.

I feel like we're missing some part of the story here. No one would be allowed to work with autistic children if they couldn't handle a shin kick.

It does matter, especially since schools designed to treat handicapped kids are supposed to be prepared for these sorts of things. There's no reason to punish a minor -- especially that young -- with a serious disability as a criminal.

Yeah, that's the other part of it. Cops usually *don't* intervene in school matters since there's another disciplinary system in place.

Yes, there are countless other punishments available *especially* within a school setting. If it happened on the street, that's another matter, but the guy is a teacher and knows the kid. More importantly, they had already suspended the kid. The teacher is a piece of shit.
