Two men trying to join Tallahassee’s version of the Mile High Club at the Florida Capitol were given trespass warnings last week.

It happened around 12:45 p.m. April 3, when an officer with Capitol Police went into a men’s restroom on the 22nd Floor to wash his hands, according to a Florida Department of Law Enforcement report.

The officer saw two pairs of shoes in the handicap stall that were nowhere near the toilet or sink. At about the same time, one of the men looked over the stall divider to see who’d come in. The officer heard what sounded like clothes being put back on and ordered the men out.

One of the men said they’d decided to hook up on the top floor at the Capitol after meeting on the gay dating app Grindr. He admitted to the officer they were having intercourse in the restroom stall, but he later denied making such a statement.

Neither man was charged because the officer did not witness any lewd or lascivious behavior, according to the FDLE report. Both of them were escorted off the property and given trespass warnings for the Capitol Complex and several other state offices.

It's open to the public, but generally if you're told not to come back to a place and you do it anyway that is considered trespassing. They were not trespassing when the officer found them.

Not necessarily. The reason they weren't charged is that the officer didn't see them fucking. He inferred it. If an officer sees you pissing, you may be arrested. If he doesn't see you pissing, you won't.

Also IIRC a few years ago some woman stripped naked on the front steps of the Capitol at night so her bf could take pictures, and she was not charged even though a police officer literally stood there and waited for them to finish before telling her to put her clothes on.
