Unless I'm misunderstanding the firing, I don't think criticizing work policies is a protected right. So how were they illegally fired?

Criticizing conditions with the intent of effecting change is what they were doing. That and that is protected. You can't retaliatory fire people for that.

Of course nothing bad happens to the person that does the firing nor the owner in any case. The person can just get their job back with backpay.
