it's to relax criminal offenses

the state is majority republican outside of chicago, so you can imagine what's going on

but uh, it also happened last year. it's back in the news because of conservative misinformation on how the bail changes work.

They're whining about it on tiktok as if it's gonna be "The Purge" and they're gonna just gonna release criminals for 2nd degree murder. Then they're saying in Detriot that law enforcement is being told to stand down when lots of murders happen.

I figured it was just the same old tiktok conspiracy bullshit that has like 25% truth and 75% bullshit.

There was a guy arguing with me in the comments saying we always say it's not true then it's not happening like you say then ok maybe it is true and then we say it's ok. I've heard others accuse fellow dems of the same shit. I mean maybe that is true, but if you're asking people why would it matter? People don't create this stuff. The natural evolution is to be skeptical incredulous and then learn and understand.

It just changes the way cash bail operates so poor people aren't sitting in jail for a year or more while they await trial for crimes they committed. Cash bail only affects poor people.

It basically comes down to this. Outside of first degree murder and most sex crimes, people can't be held on cash bail unless one of these circumstances apply.

  1. a judge determines that they are a flight risk
  2. if they are in violation of their parole or probation
  3. if they are already on pretrial release for a previous charge.
I don't doubt in the least bit a considerable amount of violent nasty individuals will get cut loose, just because lazy judges and prosecutors want to cut back on their paperwork. I wouldn't go so far as to compare it to the purge, but it will very likely make an already crime ridden hell hole even more dangerous.

Okay thanks that link def helps, especially the video. But fuck me the issue is complicated.

So I get the idea that you dont want poor people languishing in jail for months or years awaiting trial because they cant afford bail. But how are they defining flight risk? And this works great if the courts are willing to bring people to trial quicker but I see nothing saying that side of things will change.

Also I totally get youre innocent until proven guilty, but what about those cases where somebody has like really obviously committed the crime. Like the fucker has been caught in the act of kidnapping someone and theres no doubt. Theyd still send him home awaiting trial free to reoffend whilst hes out there? And again I get in the eyes of the law hes still technically innocent until hes stood trial and pronounced guilty but seems like a lot of bad people are gonna get let loose depending on how theyre defining this.

But I suppose all youre really doing is affording these offenders the same benefit that a rich offender already has lmao

There was still cash bail for those situations. That's why it only affects the poor. Is it equitable for a rich man to commit a crime and be able to easily afford cash bail to be released when a low income person who committed the same crime can't? So person A can pay their way out of jail pending trial but person B can't all because of finances? That's not fair or equitable. Is the poor person more or less of a flight risk than the financially well off person? Where will they go?

Likely what will happen is they will have to check in with something similar to a parole officer or they will be monitored with an ankle bracelet. That would make the most sense. Then they can still work and survive instead of languishing in a jail cell pending trial for a crime they may not have even committed.
