Earthbound Central has apparently received word from a Nintendo of America employee that Earthbound hasnt appeared on the Virtual Console for a number of reasons. Nintendo of America basically wanted to make some changes to the game, but Nintendo Japan is reluctant to implement those changes. Heres what apparently needs to be changed before the game can appear on the Virtual Console:
The Sky Runner song needs to be changed The Chuck Berry battle song needs to be changed The Dalis Clock enemy name needs to be changed
I don't get why the songs need to be changed... if there were potential copyright issues (like if Chuck Berry's estate or whatever sued due to likeness), wouldn't they have arisen when Earthbound was first released?
I don't get why Sky Runner needs to be changed, is it supposed to sound like something? Maybe I'm just slow but I can't pick up on it...

The lack of the Internet back in the days made it easier for things to slip through the cracks. That, and the RIAA had yet to become the sue-happy MAFIAA in the 90's.

Oh, come on... I guess I can see it, but still not seeing enough similarity to prompt a lawsuit... I guess they don't want to take any chance, and fair enough on that. Still, weak.
The Chuck Berry song is questionable, but I don't think The Who has a claim on Sky Runner. The similarity is obviously there but I don't think it's close enough.
