Looking at the Willis/Wade situation the right decision was made. While Willis may be a good D.A. it seems she has a problem with professionalism when it comes to her personal life. While the decisions I wouldn't say are wrong or even "not right " they are certainly not smart.

This is not your typical case, it is not even a typical political corruption case. This has everything up to a former president as a result every action is going to be under a microscope to begin with. Then you factor in how scummy some of the defendants lawyers are. Even the simplest of things can become overblown.

I don't think losing Wade is that big of deal for the prosecution. Willis still has others on her team and she can certainly bring in another prosecutor and get them up to speed rather easily.

In regards to Georgia in my opinion it's better for Wade to be gone than Willis. This whole trial and the enthusiasm for prosecuting Trump and his minions only exists because of her, she would be a far bigger loss than just some prosecutor we only really know the name of because of this whole shitshow.

Not a lawyer, but as disbarment is not a criminal trial, I would think so. I believe the same thing applies for civil cases.

Depends on the jurisdiction. Some permit adverse inferences, others treat disbarment proceedings as quasi-criminal.

I believe the federal courts permit an adverse inference, but any sanction must be supported by other evidence.

I also have heard that Cumeo really wasn't a fan of Trump facing legal consequences which also delayed things. Could you have imagined how things would have been different had people not been apprehensive about going after Trump?

For instance say that while Trump was president he was actively being investigated by multiple agencies with all investigators just licking their chops for the day Trump leaves office. Then by March 1, 2021 Trump has been indicted in New York for various fraudulent actions including the hush money deal, been federally indicted for fraud that occurred before he took office, been hit with a massive civil suit related to business fraud, and was being investigated federally for his role in January 6th.

This is more or less the breaking point. We're not allowed to wholesale prevent a client from testifying. We can do all we can to communicate that it's a really fucking dumb idea with horrible consequences, but it's ultimately the client's decision (and we're stuck cleaning up the mess afterwards).

First time I saw appellate counsel try to argue on appeal that trial counsel was ineffective in preventing the appellant from testifying, I was exceptionally confused. My judge started laughing her ass off when I called her to ask some questions about the opinion draft before telling me "No, we don't even humor that with a detailed response."

If you're innocent, you don't plead the fifth. Trump himself said so. And since Trump is innocent, he won't be pleading the fifth.

You can't really, but their reasoning will be that it is an election purely within the state. The problem with that of course is that a presidential election is also entirely within a state, there exists no such thing as a federal ballot.

Almost certainly. And preexisting secured creditors have priority over later in time creditors (including judgment creditors), so there may be a lot of lenders calling in if and when execution starts.

New York and/or Carroll may not end up seeing much, but it'd still be dosh and assets leaving Trump's pockets.

Trump had to testify for Letitia James in the fraud trial and it was a total train wreck. He had also said he wanted to testify for the defense but since Engoron wouldn't lift it, Trump claimed that due to the gag order he could not.

More than likely Trump wanted Engoron to say no to lifting the gag order. He was never going to testify on his behalf. If Engoron says no to lifting the gag order then Trump has his excuse for not testifying. Plus he can use it to appeal to his base by saying he wanted to testify but the gag order was in place.

I still think it would have been better had Engoron ruled that while Trump was testifying the gag order would not be in effect and he was looking forward to Trump's testimony. Trump would be mad, and it would look bad if he didn't testify.
