Trump doesnt want to testify. He is just using the gag order as the excuse. It reminds me of the teenager that knows they don't need to do something so they ask their parents expecting them to say no. That way they can blame not doing whatever on their parents.
What I think Merchan should do is call Trump's bluff and also make him boil as well. Merchan should say that the court doesn't want to stand in the way of Trump having the ability to testify so while Trump is testifying the gag order will not be in effect.
