DOL Finds Roofing Company Violated Child Labor Laws Following Teen Workers Death



The U.S. Department of Labor (DOL) has fined Apex Roofing & Restoration LLC $117,175 after a 15-year-old employee died following a fall from a roof at a Cullman, Alabama work site.
According to a release dated Feb. 7, the incidentwhich occurred on July 1, 2019involved the teenage worker falling approximately 50 feet while working on the roof of a building owned by Cullman Casting Corporation. The fall resulted in fatal injuries, including fractures to the wrist, skull and ribs. The employee was subsequently pronounced dead at the scene.

The DOL's Wage and Hour Division concluded Apex Roofings employment of the minor directly violated the Fair Labor Standards Act's child labor hazardous occupation order, which prohibits the employment of individuals under 18 in high-risk jobs, such as roofing and construction. The fine is part of the child labor enhanced penalty program, which seeks to impose stricter penalties on violations resulting in the death or serious injury of minor workers.
Apex Roofing risked the life of a child by employing him to work on a roof in violation of federal child labor laws, leaving relatives and friends to grieve an unnecessary and preventable tragedy, Wage and Hour Administrator Jessica Looman said in a statement. The Wage and Hour Division will continue using every tool at our disposal to combat illegal child labor and hold violators accountable.
In fiscal year 2023 alone, the Wage and Hour Division uncovered child labor violations in more than 950 investigations, resulting in more than $8 million in penalties.

Fine the company for 2/3 of its total assets. Require it to be lump-sum paid immediately so that it's not finance-able. Award that money to the family of the teenager.

Punitive fines need to threaten the continued existence of a business for them to be meaningful.

Once again, the fine isn't meant to be the bitch slap. The fine exists mostly to be used in future litigation to say yeah, the company fucked up. The surviving family will get WAY more when they sue, and that's the way it should be so the money actually goes to the grieving family instead of the DOL.

But putting a 15 year old on a 50 foot roof on their first day... This is an epic meltdown in judgment.

Yeah, this will depend on the parents' role in this. They had to know their 15 year old had a job and given consent for him to be there. They could have been friends with the owner who thought he was doing them a solid.

Iowa was close to doing so, but ultimately stripped that provision from the bill before it passed.

A business still would be free of civil liability if a student is injured traveling to or from work, but the amended bill says a business would be liable if a teen is hurt while driving for work.

That's what I was thinking. Or rather, hoping.

It's kind of absurd to suggest that hiring someone underage is the same thing as killing him. There should be further investigations on the adequacy of the training process and equipment, with fines as appropriate, as well. THEN we can talk about the kid who actually fell to his death.
