Side note, it's pretty infuriating how Powell is guilty of treason yet she gets to skirt by with the barest minimum of consequences even the forced apology letter was a defiant middle finger, she's crazy as fuck yet she's also calculating as fuck, even through she flipped on Trump it wouldn't surprise me to see her right back in Trump's orbit should he retake power as she's definitely the type whose shown absolute contempt for the laws of the country

He's going to be spiteful and ask for en banc. And then when he finds that maybe 1 out of 10 judges on the panel agrees with him, he'll run with that.

the opinion is well-reasoned and well-suppoorted. doesn't mean the supreme court will agree with it...

The D.C. Circuit's opinion is very thorough in its utilization of legal precedent and principles and historical analysis. It would be some monumental mental gymnastics to carve out a coherent rebuttal and overturn the decision.

I can do an in-depth look later and provide a summary if folks would be interested.

I don't see how the SCOTUS can wordsmith their way out of a very comprehensive and precedent resounding ruling. They know that a single party emperor like thing won't allow the Supreme Court to rule as it does.
