Federal Judge Dabney Friedrich struck down on Wednesday the national eviction moratorium, potentially leaving millions of Americans at risk of losing their homes two months earlier than expected. The Centers for Disease Control and Prevention has banned most evictions across the country since September. The protection slated to expire at the end of January, but President Joe Biden has extended it, first until April, and later through June. Some 1 in 5 renters across the U.S. are behind on their payments amid the coronavirus pandemic, and states are scrambling to disburse more than $45 billion in rental assistance.

Housing advocates have said that the national ban is necessary to stave off an unprecedented displacement of Americans, which could worsen the pandemic just as the country is turning a corner. Researchers have found that allowing evictions to continue in certain states caused as many as 433,700 excess cases of Covid-19 and 10,700 additional deaths in the U.S. between March and September, before the CDC ban went into effect nationwide. At least two other federal judges have questioned the CDCs power to ban evictions. And landlords have criticized the policy, saying they cant afford to continue housing people for free. The decision by Friedrich of the U.S. District Court for the District of Columbia, who was appointed to the court in 2017 by former President Donald Trump, is a victory for the property owners whove challenged the CDCs moratorium.

There's going to be a huge shuffle as everyone's evicted, but then landlords realize they have to rent to somebody.

The last year or so of rent is just gone, renters have to deal with the expense and hassle of relocating, and the only winners are going to be moving companies.

The moratorium did nothing to stop them from owing rent, only the eviction of not being able to pay rent.

For Arkansas tenants, this might be a criminal issue.

Fuck the realtors and property owners who filed the lawsuit, and fuck this judge for her ruling.

and in the meantime, federal rent aid has been sitting unspent because dozens of states have been dragging ass and refusing to distribute it, either because they want to fight over who deserves it or because they want to find ways to funnel it into their own budget...

and of course, many landlords would refuse it anyway...

Basically the judge was like "This thing that you're referencing that you say gives you the authority to ban evictions, I think you've taken some words from it and defined them way too broadly. Your authority is limited."

Well it's true. I called this as soon as the eviction bans went into place, as soon as they end we're gonna have millions of people with thousands of dollars owed in rent due ASAP. Because I understand most people are really, really fuckig stupid. Many of us know people who've been collecting their UI, not paying rent, and spending money on frivolous things.

So I ask all the folks outraged over this: if someone owed you thousands of dollars, would you just say "oh thats ok, I'm a socialist, I don't believe in debt" or wtfever it is you folks tell yourself to justify this insane idea housing should be free and profit = EVIL

As someone who is a landlord I spend some time on different landlord websites or sections of reddit. Their perspective is basically hey nice program, but the tenants have to sign up for it to get rental assistance and none of them are. Why am I stuck losing money?

AFAIK, it ONLY protects you if you lost your job/ability to pay rent.

If you had drugs in the house, or you were damaging the property, or any of several other things a Landlord might want to evict you for they still can.

I'm not sure how the 2020 moratoriums worked, but the 2021 ones required tenants to declare that they can't afford the rent and have been paying whatever rent they've been able (even if zero).

Anyways, can landlords start immediately evicting those protected by the moratorium or is there a delay before it happens?

The big issue with all this, and a lot of aspects of covid, is that it's hitting people so unevenly.

Landlords aren't by their nature bad guys any more than people than own restaurants or shops on mainstreet are but many of them had their businesses decimated by the pandemic and in many cases the government literally made it illegal for them to make money.

Maybe society needed it to happen to save lives but if that's the case why shouldn't society pay for it?

Instead of spreading the cost of the pandemic we are basically leaving some people untouched and other people ruined.
