Booker T has filed a lawsuit against Activision because he claims that a character in Call of Duty: Black Ops 4 is based on G.I. Bro. Yep. PWInsider reports that Booker Huffman filed suit against Activision Publishing, Activision Blizzard, and Major League Gaming alleging that the character of David Prophet Wilkes is based on the comic book version of the character he used in the early 1990s and later in WCW.

Huffman says in the lawsuit that he created a comic book based on G.I. Bro that was published in 2015 and that he owns the copyrights to the character, but that Activision used the image in Black Ops 4. The suit notes, In Call of Duty: Black Ops III, one of the specialist characters was David Prophet Wilkes, who had replaced 90% of his body with cybernetics to enhance his fighting ability. For the prequel, Call of Duty: Black Ops 4, Defendants chose to depict Prophet as he was before he remade himself. They could have drawn him any way they wanted. But they chose to steal Booker T.s G. I. Bro.

Huffman says he was never contacted about the character and that Activision is infringing on his copyright, have created a derivative work and have distributed, or caused to be distributed, by sale or otherwise, copies or derivatives of the G. I. Bro Works by distributing the game Call of Duty: Black Ops 4. He has asked for a jury trial.


PWInsider reports that the lawsuit from Booker T against Activision over the look of a character in Call of Duty: Black Ops 4 will be headed to trial, as Booker requested a jury trial and selection will happen on April 19. Selection happens at 9 AM that day, presided over by District Judge Robert W. Schroeder III.

Booker is suing Activision Publishing, Inc., Activision Blizzard, Inc., and Major League Gaming Corp, claiming that the Call of Duty character David Prophet Wilkes was based on the comic book version of his former wrestling character GI Bro, which he used in the early 90s and near the end of the same decade. He originally filed the lawsuit back on February 2019. He says there were two GI Bro books released in 2015, and Booker created the character and owns the copyrights. However, he claims that Activision began utilizing Booker Ts G.I. Bro image in Call of Duty: Black Ops4 which went on sale in late 2018.

The game is believed to have earned over $1 billion since it was released. Booker has requested that he be awarded whatever the court decides.
