The cop drew his gun cause the guy had a gun holstered in the car, most likely on his hip.

Probably safe to assume he didn't tell the cops he had a gun considering his general attitude about providing them any information.

So in general, if you're pulled over while driving with reasonable cause, and a police officer asks for ID and registration, you are required to give that info to the police officer. An alternative is the officer looking up your information, either in their police cars or by bringing you down to the precinct to verify your identity and vehicle registration. However, if you're illegally pulled over, you are not required to show ID or registration.

In this case, this was a DUI checkpoint. Unfortunately, the US supreme court has found that DUI checkpoints are legal, and that a motorist must answer the basic questions and provide ID during said stop. Some states, however, passed specific laws to outlaw this; while others passed laws to make it legal under specific circumstances (e.g., must be done at night, must be advertised that there will be a DUI checkpoint, etc.).

So if this driver was in a state that made it illegal for a DUI checkpoint, he was full within his rights to refuse to answer and refuse to hand over his ID and registration. But all other states, the driver was wrong.

He acknowledged he had a gun after it was already seen. That's not the same thing as telling them he was armed. Which should be the first thing out of your mouth during a traffic stop.

funny how that never applies to us (not-cops) with the cops. those with "training" get to fear for their lives, but we need to remain completely calm while we're being drawn on. doesn't quite add up.

Amazing country we live in. People will fight for your right to open carry, conceal carry, whatever carry, but if you don't mention it to the cop who approached you he'd be justified if he shot you for twitching a finger without even thinking about your gun which everyone wants to be normalized.

I mean the NRA justified Philandro Castille's murder even though he told the cop he had a gun in the car.

why just law enforcement. can i just shoot someone if i happen to see a gun on their hip because they weren't "up front" about it? If people in this country want guns to be normalized and treated loosely why should they have to announce they have one? You can't allow it to be a fashion accessory in one case and then act like its a serious tool that needs to be disclosed at all times in another.

I never really get the point of these videos. Why waste a half hour bitching at a cop for something that would otherwise take a minute? Unless there's some correlation to running info and false arrests, seems like absolutely nothing.

because your rights are your rights? "it'll only take a minute" is a poor excuse. That's like saying "why didn't she just flash the cop when he asked it would have only taken a minute and she wouldn't have had to deal with getting arrested". Just because this is trivial in comparison doesn't mean people should just allow cops to do things they shouldn't do for the sake of convenience.

'a dumb thing' isn't justification for getting a gun pulled on you in this situation. someone legally carrying a gun shouldn't have a gun pointed at that them by a cop for not "disclosing" it. stop blaming the victim here. we all know how trigger happy cops can be. he'll just put "I was scared" in the report if he had acted on impulse and shot the man..and you'd defend it. that shouldn't be normalized. He has 2nd amendment rights as well too, right? what if he just didn't even think about the gun because its as common to him as his wallet is. You can't have it both ways.

That's a very poor comparison. It would be like saying you should comply to unwarranted police detainment. Those videos I can understand. If they have no right to take you out of your car, then fuck that. But papers are papers, literally a minute or two.

no its a fine comparison. again "a minute or two" is a poor argument. If you don't need to don't allow cops to try and force you to. If cops randomly went door to door and asked for ID, arresting anyone who said no would you be ok with that?

Think we're going down a poor quality slippery slope here, but yes, assuming there was some reasonable imperative for going door to door. If it's some kind of dick waving power move by a local station to show they have "the power," then no. If there's a murderer hiding somewhere in a neighborhood, sure, even though I don't think police would ever actually operate like that in any realistic scenario. Making it a more realistic situation, if there was some power tripping cop pulling over dozens and dozens of people every hour just to run their IDs for some random reason, then that would be an abuse of power to complain about. For someone who was stopped in a legally sanctioned stop, even if it's a legal gray area, then just fucking comply for three seconds.

A cop needs training not to feel "threatened and terrified" every waking moment.

Why should it be up to a civilian to be perfect when dealing with cops and not the other way around?

Hell, you should be able to go as far as to yell abuse in their face and they won't be allowed to touch you, only calmly de escalate. That's the standard they should be held to.
