I took one shot and immediately blew into it. Note: .08 is legal limit. .40 is dead. I blew a EE. That means "error: above what it is calibrated to be able to measure." Why? Fumes were still in my mouth and upper respiratory area before the esophagus/trachea split and they were measured in the reading. Just saying.

That's why I trust the Blood Sample test more than the Breathalyzers.

Far more accurate, but slower to diagnose.

Having said that, I have a friend that got pulled over because she veered due to checking her phone.
It was a night, and she had been drinking. But only had .09 and she is tiny.
All that being considered, she passed the field test and was breathalyzed after.
Seem fucked to pass a field test and then get breathalyzed.

Long story short. You have no rights while in your car.
This goes for almost any case when you in your car.

I was alert and completely coherent and I remember the entire ordeal. I don't think the equipment you were using was working properly tbh.

People get drunk at different levels than what is standardly recommended or in the law books.

The reason I want a more severe one is that "One Size Cannot Fit All" when it comes to alcohol.

Impaired judgement happens at different BAC for different people and some people will have it occur at much lower levels which could lead to fatal results.

Ya, it's total BS. I can't say the alphabet backwards at any point...if they still use that.
And believe me, my mom died in a single-car crash, no alcohol involved, probably fell asleep.
So, I understand road safety. But the militant anti-DUI shit is often unreasonable.

Having said that, I live in a party town and I'm not sure how there are not at least 100 arrests a week.

That's the inversion of my luck. I have been in the car as a passenger with drunk drivers, sometimes blackout drunk, literally several hundred times in my life and never had anything happen. Granted I would be hesitant to put myself in that position these days. This was mostly college years which was over a decade ago. As far as pedestrian is concerned, there is no such thing as luck. Either you're in the wrong place at the wrong time or you aren't paying attention. I pay shitloads of attention. Apologies if I come across as condescending, but with all my life experiences, I can't help but kinda laugh and shrug off statistics and straight-edge logic. I realize that makes me a dick, but if my life has been that contrary, that's just naturally how I'm inclined to see things.

My brother on the other hand has been hit as a pedestrian 3 times in his life. Never drunk drivers. Once by a student driver and all 3 times because he wasn't fucking looking before walking into the street >_<.

should be like that across all 50 states really....if you aren't old enough to be drinking you certainly shouldn't have any blood alcohol content while operating a vehicle.

IIRC its not just while driving. Say youre being a dumb teen in the middle of the night somewhere and your eyes look shiny, they may have you blow, and youre getting the hammer dropped.
In Vegas, its legal to drink in your own house if your parents give you permission (Ive heard of other places like this as well). I personally think its bs the drinking age is 21. If you can live on your own, get married, and die for your country, you should be able to drink.
I almost got a distribution to a minor charge while in Utah because I was drinking with my 20 yo BFF who was married, pregnant (we didnt know at the time but found out later), and owned the house we were at. They wanted to charge me (22 at the time) and her 23 year old husband.

The change in the law itself makes sense (as others said, some people do get impaired between .05 and.08, and laws have to be designed for the lowest common denominator) but their likely reasoning and justification for it (using the Mormon religion to try to police those who are not) is ridiculous and flawed.

Nope. What I said applies to all superstitious beliefs equally. I simply meant that I hear that sort of thing more commonly from religious people. Plenty of atheists have their own superstitious garbage that is just as dumb. I just hear about it less frequently.
