But there are people who do get impaired at < .05% BAC, and law's are designed for the Lowest Common Denominator, as a Safety net. At least in NY. Having said that, I have a friend that got pulled over because she veered due to checking her phone. It was a night, and she had been drinking. But only had .09 and she is tiny. All that being considered, she passed the field test and was breathalyzed after. Seem fucked to pass a field test and then get breathalyzed. Long story short. You have no rights while in your car. I could have just taken some time off from drinking and been fine. I blew .24 and that was 3-4 hours after my last drink and I felt only slightly buzzed. I was alert and completely coherent and I remember the entire ordeal. If you can live on your own, get married, and die for your country, you should be able to drink. I almost got a distribution to a minor charge while in Utah because I was drinking with my 20 yo BFF who was married, pregnant (we didnt know at the time but found out later), and owned the house we were at.
