A Judge has DENIED to revoke a bond of 30 y/o Dustin Cavanaugh who is accused of intercepting communications based on allegations he violated conditions of pretrial supervision by posting items on the internet as he is allowed to remain free while on bond.

He was indicted in October on one count of interception of communication for recording a telephone call in September without the other's permission and then posting it on the internet.

At the Oct. 22 bond hearing, Circuit Judge, Daniel P. Dwyer released him on his own recognizance as he was not allowed to access or post on social media and not recording people without consent and not to possess ANY electric such as cellphones, tablets and computers.

Dwyer said "Unless you can produce evidence that it was Mr. Cavanaugh himself posting on social media and not somebody on his behalf, i would respectfully deny the motion to deny the bond". He also stated there was no evidence to show he possessed any internet accessible devices.

Public Defender David Littrell argued by showing screenshots of his twitter account in October and November but an Oct. 24 screenshot stated "Until further notice, all tweets are made by me..i am his girlfriend and in charge of all of his social media until further notice"

A Nov. 24 tweet said "the user no longer referred to Defendant in the third person and began using the first person description"

A motion cited the Nov. 29th tweet with a link to the Washington Post on real estate transactions including one for an assistant state's attorney prosecuting his case.

State Attorney, Gina Cirincion called these posts "self-authenticating" and told the public lawyer that his client violated the court order repeatedly and expressed concern that one post included information about a prosecutor where state attorney's are often targets of threats and harassment and demanded his bond be revoked.

She said it was NOT a minor transgression as his lawyer finally admits that these posts show that it was Dustin who posted them however, the judge said that although he was concerned, he noted that these were also on public domain and is easily accessible before social media because of the internet..

His trial is set for Jan. 28th next year as he could face a maximum of 5 YEARS in Prison on the charges

Yeah, I said in the last topic that these charges sound like complete bs, and as if the state is just really intent on going after this dude for some reason. Two party consent laws for recording of conversations are stupid and the law in far less than half of the states. (cue Zeus to come in and make a fool of himself on that point yet again)

What's the point anyway? Recordings are not even legal evidence most of the time because it is almost impossible to prove the identity of the speakers...
