there's an interesting ethical question about starting to enforce a law that was never enforced before.

it's similar to speeding tickets, just in this case on a staggeringly bigger scale.

there are places in the city where there are never speed traps, or maybe if there are, they're easy to avoid. since everyone "knows" this, everyone speeds in those areas. some days there can be 10-15 cars all barelling through an 80kph zone at 105kph or more.

ok, but what happens when for the first time in 10-15 years, all of a sudden there's a new effective speed trap there, and the cops get to write hundreds of tickets per day for a few days or more. the people wouldn't have broken the law if the law had been enforced in the first place.

Wouldn't matter. People would still speed. Your example is like piracy. People get fined for it and still do it.

it's interesting because it doesn't have a clearly correct answer. if some law was from the 1800s and was not even relevant anymore, and yet many people were technically breaking it, would it make any sense to suddenly start enforcing it? for one thing, law isn't so black and white that the law says X and so X is illegal. there's interpretation and spirit VS letter of the law.

but, this is not completely analogous to the illegal immigrant thing anyway. illegal immigration doesn't just mean you broke a law, it means you aren't even a citizen of the country in the first place.

it's a difficult or impossible to compare situation. comparing it to any kind of normal law-breaking doesn't work. this isn't "an element of the system broke a rule of the system and so faces the consequences imposed by the system"; rather it's "an element thought to be in the system was discovered not to be an element of the system". it's a fundamentally different concept.

basically I kind of agree with you, though maybe not so coldly/harshly. the border should have been enforced in the first place. it's unfortunate that we have the situation that something was not enforced for so long, luring people into abusing it, and resulting in the current problem, but that doesn't mean it shouldn't be fixed.

It was always enforced. They just got harsher more recently. Plus they also didn't have the proper manpower to patrol the entire border and technically still don't.
