Worth noting: with the exception of the North Dakota bill, these bills all specifically relate to running over protesters that are blocking streets. None are law, yet. But in NC the bill passed the house and is starting in the senate. I think TN also.

my concern is the difficulty of proving such action was 'willful and wanton' beyond a reasonable doubt.

this is criminal law we're talking about, and one of the basic rules of the road is that as a driver, you've got much more responsibility/liability than pedestrians, which makes up for the fact that you're controlling a metal object that weighs a ton and they are not.

People are going to misinterpret or otherwise abuse this law being proposed across all these states, and you're going to see homicide rates skyrocket again.

I do. Legally, it may prove difficult to prove that an action was 'wanton'. What has worked well in the past is that the driver is liable unless there is evidence the pedestrian deliberately forced themselves into the path of travel in such a way as to prevent the driver from having any method of preventing the accident.

I understand the premise but the problem is the potential for misuse. White guy flees Antifa/BLM = necessary for safety. Black guy escapes KKK = unnecessary/wanton action against peaceful protestors. The timing of the bills doesn't have good optics at least. If it were enforced consistently then the law makes sense.

I can see how these laws can be "creatively interpreted" to legitimize the injuring or killing of "pesky" protesters. For example, drive slowly into a crowd, decree that they've become dangerously belligerent, then step on the pedal.

I do not give a single shit what you're protesting. Get the hell out of the street. If you're blocking the traffic, especially if you're blocking the freeway which has happened before here in SoCal. Not only would I support a bill like this I would actively encourage people to run them over.

Eh. I'm okay with legislation that protects drivers from criminal or civil penalty if happen to injure or kill protesters either accidentally or while escaping a hostile crowd.

Don't want to get hit by a car? Don't protest in the street.

That doesn't mean I think it's okay to seek out crowds on the sidewalk to run down or what have you.
