1) How do you determine when an ideology is a threat and needs to be censored?
Uhh, when it threatens you? Not that hard to grasp. Fascism is a direct threat, so there you go. Not really a question that needs to be asked.
2) Who makes the determination?
The people who decide to be fascists are the ones who have decided they should not be heard.
3) What protections are in place to prevent it from being used to abuse political opponents?
In the USA, none. This is a bit of a non-sequitur, and arguing from the assumption that authority figures are the good guys. The US government, and the people it serves (note: not the general populace or the working class), already persecute and censor progressive and left wing views quite successfully. Of course, the USA has always embraced enough elements of fascism within its own core to be regarded as an enemy of, well, not being fascist.
