I think it's fine the way it is. It IS a legit strategy (even if it is a nefarious one), and even without that particular strategy, it would change the game too much to implement a change.

Let's say Team X is in second-to-last and team Y is in last, coming from different detours. Team X gets to the U-Turn board and, not knowing who has left the other side of the detour yet, tries to U-Turn team W, who is already ahead of them. Under Peridiam's rule, production should force X not to U-Turn W, in which case the only team they wouldn't be prevented from U-Turning is Y, screwing them when they weren't even the target. Under burke's rule, either X gets penalized for something they could not have possibly known not to do, or they are scared shitless to U-Turn anyone, reducing the odds of U-Turns even being used. This is magnified in another situation - if X is already U-Turned and there is another one open, they either take the risk of catching up at the other detour and not having any worries next round, or they make it so that even if they do manage to survive this round, they are completely buried in the next round. Everyway they look at it, they lose.

And if you try to make it arbitrary like "they have to know the other team is ahead of them and/or do it for nefarious purposes in order to get the penalty," you're getting into really dangerous waters.

Just leave it alone.
