The supreme Court has upheld that freedom of speech has limits. You can not for instance yell fire in a crowded theatre or openly call for and advocate the harm of a human being. They have also upheld that students at school are further restricted. While they do have freedom of speech, the school must provide a safe learning environment for everyone. That includes being able to punish name calling and bullying on school grounds. The issue with this case is that it happened off campus, but in the interconnected world we have today schools are being pushed to do something about cyber bullying. So if the kids said these on a public forum where any student can see it they would be well within their rights to punish. If they said this in private they would be safe as long as no one had a problem with it and reported it. Which must have happened for them to have seen it.
