Do you think it was fair of the school to suspend the pricks for saying racist things?


4 White High School Students in Saline, Michigan are SUING the district after they were SUSPENDED for posting racist remarks against black students in school!!

The PARENTS filed the suit for their kids alleging they violated their kids first amendment rights on the white students who targeted black football players in school

The admin gave a time out on the racists after they used the N word and made white supremacy remarks on social media

An inclusion meeting was held at the school last week when a white parent was caught on camera asking an hispanic dad "Why didn't you stay in Mexico?"

Community members took to the streets for a rally to slam the racism in their district

The white kids are NOT identified and stated the school made grossly negligent decision to verbally suspend the students and barred them from Saline High School indefinitely

The suit says they admitted to using the N word and other inappropriate and racist language but said it was in between friends and in a "joking manner" and are now suing for damages and injunctions reinstating them and having their names cleared

David Kallman, who represents the students and their parents said the district has no legal right to impose discipline carred out and violated their constitutional rights by reckless judgement since the racist remarks happened off school grounds

2 of the students have returned while the other 2 face explusion after they posted further racist messages against black students with gorilla emoji's and WHITE POWER and THE SOUTH WILL RISE AGAIN as they apparently were offended their football team was majority BLACK!!

A school meeting was held to talk about he racist remarks as Adrian Iraola, a native of Mexico and a US citizen was sharing comments of his own 2 daughters when Tim Burtell, who has 6 kids in the school said shockingly "Why didn't you stay in Mexico?"

It led to shocking gasps from the audience as audience members told him to leave but Burtell took the mic and said "Try being White and walking in a White neighborhood, see what happens"

He then dismissed the racist tweets and said "nobody got hurt. let kids say what they want. It's their right to hate whoever they want"

The school says they do not welcome these kinds of comments as it goes against their values and beliefs in their school system as the Inclusion rally had people holding up signs "Racism Not Welcome"

You know what, the school might actually have legitimately violated their First Amendment rights here if this is a public school. The kids were being stupid, like so many other kids, on their own time outside the school and the school overreached into their lives outside of the school and deemed something they said to be a violation of school policy.

This would equate perfectly with the city council where you work trying to punish you for saying mean things about your coworkers after you left the city and went back home for the day.

It depends on the rules. Like at my job, one guy got fired for posting bad things about the work place on FB. Technically, I'm in an at-will state. So they can do whatever they want. But there are still probably rules against post negative things about the job. If the school said the rules were to not be racist (in or out of school), and they broke the rules, then the school can punish them, I would think...

Hm. This one is a bit tough. It's clearly not ok what the kids did, but it's also not illegal. I don't know exactly the limit to what schools can punish people for. You can obviously get in trouble at public schools for things that aren't breaking the law. I imagine the school has the right to suspend these kids but I can't say for sure.

The supreme Court has upheld that freedom of speech has limits. You can not for instance yell fire in a crowded theatre or openly call for and advocate the harm of a human being. They have also upheld that students at school are further restricted. While they do have freedom of speech, the school must provide a safe learning environment for everyone. That includes being able to punish name calling and bullying on school grounds.

The issue with this case is that it happened off campus, but in the interconnected world we have today schools are being pushed to do something about cyber bullying. So if the kids said these on a public forum where any student can see it they would be well within their rights to punish.

If they said this in private they would be safe as long as no one had a problem with it and reported it. Which must have happened for them to have seen it. So they were making someone uncomfortable.

Hate speech is not defined by federal law. I can walk up to you and say I hate you for any particular reason. That will not put me at odds with the First Amendment. The problem with this logic is that it inherently bans it anyways even in private, as you just said its okay unless they find out about it anyway. There is no limit to the reach of the school into these childrens lives that you are proposing is reasonable.

If these children want to be stupid... lets face it, children using your reasoning too bad so sad if they go to public school. It also makes it so that theyre inherently being punished for being poor as these restrictions wouldnt be imposed on them if they went to a private school or were homeschooled.

Any workplace would fire someone for posting racist shit on social media, including a government workplace. Fair for a government school to do the same. Especially when it comes to minors, who do not have nearly as many rights as adults (rightly so, since minors tend to be pretty stupid, as seen here).

Like someone else already said, if you're throwing around racial slurs, you're looking for trouble. Don't get all shocked and appalled when you find it.

If a speech isn't illegal, then you haven't hit its limits. The fact that schools are being pushed to "do something" in no way excuses overreach. Finally, and perhaps most importantly, who was the actual complainant? Because it sounds like it wasn't the students who were called the names and instead was other people who saw the remarks? Granted, either way, why should this be treated differently than other trash-talking between students that the school doesn't attempt to stop?
