What I am saying is that each Switch would have hardware-based encryption keys (all switches have the same keys) and because they are hardware backed are tamper proof. These keys would be used to encrypt the Game ROMs (and also the firmware). In the case where any of the hardware keys were compromised, the system has multiple hardware keys on a rotation, where games released in certain years use certain hardware keys and in other years use different ones.

This stuff is very basic, and is the foundation of secure booting and software execution on ARM devices, just like the Switch.
