This response does nothing to refute my assertion that this is not the sort of conduct that will negatively impact employers. The whole point of this discussion is that their aversion to such conduct is stupid and an overreaching invasion of employees'/applicants' personal lives, not to try and suggest that the company didn't do what they very obviously did. If rewording the question will help you understand it better, sure (though we should perhaps stick with "unprofessional," since "questionable" is substantially more vague and not relevant to the matter at hand here).
