And as much as I wish he could be called Captain Marvel (he can, but probably never will again for branding reasons), its ultimately DCs fault. They were pissy that Captain Marvel was stomping Supes in sales so they sued Fawcett and caused the comic to shutter. Captain Marvel did nothing for a while. DC eventually bought the character but sat on the name so long that Marvel Comics had already gotten the copyright because hey, were Marvel, so why shouldnt we have a captain marvel?
