Racism falls into both of those categories.

The actual fuck? No it doesn't. Not even close. Heck, most porn doesn't meet the criteria for obscenity. Fighting words require naming a specific threat and imminent time to be exempt.

Hate speech is still protected by the first amendment. However, specific laws ban certain types of discrimination and harassment in schools and businesses, and it's very easy for hate speech to cross into harassment.
