Donald Trump is the only president in U.S. history to be impeached twice this time for his role in inciting a deadly assault on the Capitol by his supporters but he is still poised to leave office with a job approval rating that is fairly typical of his entire time in office.

A new NBC News poll found that 43 percent of voters nationwide gave Trump a positive job approval rating, just barely down from 45 percent who said the same before the November election and the 44 percent who approved of his performance shortly after he took office in 2017.

The same poll found that 35 percent of voters including 74 percent of Republicans but just 30 percent of independents and 3 percent of Democrats believe that President-elect Joe Biden did not win the 2020 election legitimately.

Sixty-one percent of all voters but just 21 percent of Republicans say Biden did win legitimately.

While a record 10 House Republicans broke ranks to vote for the president's impeachment last week, Trumps approval rating among Republicans in the poll shows few signs that GOP voters are widely disillusioned with the president.

Almost 9-in-10 Republicans 87 percent give Trump a thumbs-up, compared with 89 percent who said the same before the November election.

Defamation is a false statement that damages someones reputation. To win a defamation suit in most cases, plaintiffs must be able to show that the statement against them is false and that it caused them to suffer damages or harm, such as losing their job. Defamation per se is a false accusation that is so damaging that plaintiffs dont have to prove that they suffered damages.

Under New York law, examples of defamation per se include falsely accusing someone of a heinous crime or having a loathsome disease. Falsely claiming that someone is homosexual had also been lumped in.

It meant that it was so shameful and such a disgrace that it was just assumed that obviously your reputation has been injured and you don't have to prove that element of damages, Eric Lesh, executive director of the LGBT Bar Association of New York, told NBC News.

The Second Department agreed, writing that the profound and notable transformation of cultural attitudes and governmental protective laws for LGBTQ people influenced its decision. The court cited a 2003 U.S. Supreme Court decision, Lawrence v. Texas, which found that laws criminalizing homosexual conduct were unconstitutional, and the courts 2015 decision in Obergefell v. Hodges establishing the right to same-sex marriage throughout the country.

Based on the foregoing, we conclude that the false imputation of homosexuality does not constitute defamation per se, the Second Department wrote in its Dec. 23 decision.

Lesh called the ruling a no brainer, but said it is an important way to evaluate how far weve come on LGBTQ equality.

President Donald Trump's approval rating has hit a record low as the House of Representatives moves forward to impeach him for an unprecedented second time, according to a new Politico/Morning Consult poll.

The survey wrapped up as Congress launched its first impeachment proceedings on Monday. It found that Trump's approval sits at just 34 percent, the lowest it's been in the four years since he first took office, according to Politico/Morning Consult.

More than six in 10 voters, or 63 percent, said they disapprove of the president. The largest drop in approval existed among Republicans and independents, as a great majority of Democrats already disapprove of Trump's performance.

Among Republican voters, 75 percent said they still approve of Trump, a number that has dropped from the 83 percent reported in a Politico/Morning Consult poll conducted in December.

For independent voters, the decline was similar: 29 percent of independents said they still approve of Trump, down from 38 percent last month.

The poll was conducted between January 8 and 11 and surveyed 1,996 registered voters online. It has a margin of error of plus or minus 2 percentage points.

According to these results, Trump will exit his term as one of the worst-rated presidents in U.S. history, along with George W. Bush, Jimmy Carter and Richard Nixon.

Trump has faced a severe backlash in the past week after a mob of his supporters stormed the U.S. Capitol on January 6. The violent attack resulted in five deaths, including that of a Capitol Hill police officer, and delayed the congressional certification of President-elect Joe Biden's victory.

Trump has since faced calls for his resignation and removal from both sides of the aisle.

Rep. Pramila Jayapal (D-WA) has tested positive for COVID-19 after sheltering during the U.S. Capitol insurrection with Republican members of Congress who refused to wear masks.

Wrote Jayapal on Twitter: I just received a positive COVID-19 test result after being locked down in a secured room at the Capitol where several Republicans not only cruelly refused to wear a mask but recklessly mocked colleagues and staff who offered them one.

Only hours after Trump incited a deadly assault on our Capitol, many Republicans still refused to take the bare minimum COVID-19 precaution and simply wear a damn mask in a crowded room during a pandemiccreating a superspreader event ON TOP of a domestic terrorist attack, Jayapal continued. Any Member who refuses to wear a mask should be fully held accountable for endangering our lives because of their selfish idiocy. Im calling for every single Member who refuses to wear a mask in the Capitol to be fined and removed from the floor by the Sergeant at Arms.

While I am isolating per the Capitol Physicians instructions, I will continue to work to the best of my ability because the deep urgency of our many crises is paramount, Jayapal added.
