It's not a win/win because Chief Wahoo is an excellent logo. And they've been using it for decades. There have been a few tweaks, but they essentially started using that exact logo in 1951.

If they didn't then they shouldn't be allowed to sell it/use it or even take it IMO.

They did not have permission, however precedent dictates they're allowed to license their creeper pics. However, that's to other publications and I don't think a court has ruled on whether the creeper pics are fair use to the person getting creeped on. Logically you'd think the court would rule in the celebrities favor on the matter, but copyright law is fucked up so who knows.
