Every person along the line denying this or denying a delay all have blood on their hands. There was that case previously where someone was completely innocent, even the prosecution said he was innocent, and the judge said he must die anyway.

It's fucking abhorrent, and I am 100% against the death penalty.

This decision is probably the least of things to be upset about surrounding this case considering that the hearing to dismiss charges is already scheduled before the execution date. There is a lot of foot dragging going on though.

Dealers already do pretty heavy time. While in a perfect world I'd have no issue with the most prolific dealers being executed, that ain't the world we live in. So long as you have the death penalty, innocent people will be killed no matter how high you set the standard of proof.

the classic Russian propaganda tactic is to accuse your political opponents, dissidents, etc. of being drug addicts or dealers. it's amazing how many journalists critical of the regime happen to be caught up on narcotic charges. Not to mention the big push at the start of the Ukraine war was that Zelensky is a coke addict and their soldiers are meth-riddled nazis.

now add that to the GOP plan to "investigate" their opponents and execute people for drug charges...

The rigidity of the principle for finality in criminal convictions is wholesale unjust. It's necessary to a point to ameliorate the perpetual cascade of meritless post conviction motions and habeas petitions, but it needs to be much more flexible in these sorts of situations, especially when you have both the prosecution and defense in agreement for an evaluation of newly discovered evidence.

Given the technological advancement in the forensic areas over the last few decades, this should be a no-brainer.
