Brief background if u haven't seen my other topics on this:
Shitty neighbor has been repeatedly parking in front of my garage for a couple years now. I use a wheelchair and this blocks my only way of leaving/entering my home. Neighbor is fully aware of my situation and continues to park there, HOA and law enforcement have not helped me.

So a month ago or so I just left a bigass traffic cone in my driveway, it actually stopped the guy parking there and I thought I could finally stop worrying about all this

Well a couple weeks ago I got a violation warning from my HOA about "improperly stored belongings" in regards to the cone. It pissed me off since they've done nothing to help the parking situation, but I didn't reply to it because they weren't threatening a fine or anything

Yesterday at some point, someone removed the cone with no warning. I would assume it was the HOA, but their violation letter didn't communicate this would happen. I suppose it could have been the shitty neighbor too, since I definitely wouldn't put it past him.

Either way, filing a missing property report with the HOA wouldn't do any good since they wouldn't help me with stolen packages in the past, and this cone wasn't supposed to be there in the first place i guess. I'm just so tired of all this lol. I don't really know what I can do other than join the next HOA board meeting and try bitching at them

Theyve done all that. The cone seems to have put it to rest for a few months though.

Yup, I left notes on his windshield explaining the whole situation politely. It took a while to actually find out who the neighbor was, but we have spoken to him face to face multiple times now. I have stared him in the face while sitting in my wheelchair as he backed his car out. He's just like "oh sorry it won't happen again" (it happens again)

Yeah I do really just need to tow him next time I catch it. I have called before, and they always take so long to get out here, the neighbor comes and moves it by the time they call back. Other times its just really late and I dont want to deal with it OR it's a different car and I want to give him the benefit of the doubt (he gets new cars really frequently its weird). I just need the balls and patience to do it next time -_-

TC, can you check and see if your area has pro bono services?

Like once every few months attorneys in my town will have an event where they go be free consultations.

Probably won't get a full solution out of it but it lets you have a better idea of the options.

Is this a stand alone house that you own if so that should be ground enough to have it towed if it is parked on your private property, and I would do it post haste with an anal HOA that would likely find violations for you with it being parked there or something. If you are disabled and they are doing anything to infringe on your rights get a lawyer because they are basically screwed. And document everything.

Hmm uhh I am nonbinary but I don't really put effort into presentation either way. I think the HOA head is a lesbian woman also? Imo I think both the HOA and neighbor are just shitty and dont care if it doesn't benefit them

this. somebody taking up a designated parking spot (especially for someone who has to use a wheelchair) is the one of the lowest things somebody could do to someone.

If it is and you would get in trouble for leaving your vehicle like that, then it's definitely a discrimination thing if they're not actioning it

Do you have the legal right to that area of your driveway? What is in your contract / lease / ownership papers?

Any time it is there call a tow truck on it. So long as you have the legal right to that spot there's nothing anyone can do. And you can pay a lawyer to draft up a C&D for relatively cheap. Most lawyers give some kind of free consultation up to 30 minutes so actually look around. You can check your state's BAR page to find relevant lawyers afaik.

Your neighbor is preventing you from the ingress and egress of your domicile. You have attempted on multiple occasions from having your neighbor do what they are legally supposed to do. Your HOA, who you pay fees to, are also unable or unwilling to help you.

Lawyer up, send a C&D to the neighbor, and perhaps force the HOA to do what they are supposed to. Don't worry about repercussions, if they try that throw it on the pile.

Huh really? This never even occurred to me. Do you mean on the side of the HOA or neighbor? When the neighbor started doing it, I don't think he knew who I was or anything. Oh I agree but tbf I haven't been pursuing it aggressively with authorities like I should probably. I filed a few tickets with the HOA a while back and just gave up because they wouldn't do anything. We had a cop come out once a while ago and they said they couldn't do anything. At the time I couldn't even find a tow company willing to come out

Frankly I'm barely able to function a lot of days cuz mental health shit so I dont know that I'm capable of pursuing this consistently with law enforcement/etc. I mean this shouldn't be happening, but its kinda on me in a way for letting it slide for so long

Nahh i really should have replied to the violation message sooner, and maybe the cone wouldn't be taken lol. I planned to just tell them I wouldn't move it unless they gave me an alternative to deter parking, but I just put it off too long

Its a condo, and I think there was some grey area about the driveway not being my private property, and the cops couldn't help because it wasn't public property either. Either way I did find the tow company that is assigned to my complex so I know who to call now :b

It is my designated parking spot with the condo unit, but im not sure of the exact legal designation. I know that some local tow companies would not come out to tow at my complex, I had to find the specific one contracted to tow here

In this case I'd definitely just ask a lawyer.

The HOA is blowing you off, likely not to discriminate, but because they don't see it as worth causing a fuss over. "It's not an all the time inconvenience/it doesn't stop them from driving"

The neighbor probably views it the same way. "Well they don't have a car so it's not that big of a deal"

Since the police might not be able to legally do anything, that leaves a tow or lawyers.

However a tow might come to the same conclusion (not illegally parked) or it might explode the situation even larger.

A lawyer would be able to best advise what to do. I'd take whatever existing documentation of what rights/guarantees you have irt the driveway (certain footage past the garage, etc) that way you have all relevant info on hand.

I... assumed that, but sometimes when he parks there there are other free spots i guess maybe they were all full when he actually parked.

Yeah I kinda made it hard for myself by not documenting all this in an organized way. If I reach out to a lawyer I'll have to scrub through my phone gallery/discord/texts to find all the pics I took, and it probably won't be comprehensive

Oh huh yeah a bike in my driveway shouldn't be a violation since it's a vehicle huh. Im not sure what I would chain it to to prevent it getting stolen though
