Always wondered about the squatter problem, assumed it was just renting issues, but laws actually protected people who, without permission, just took up shop in someone's property? That's kinda nuts.

As someone who was homeless, I can understand desperately wanting a place to stay.. but that sure as hell isn't the way to go about it. Damn.

Generally the problem with squatters isn't that they can't be evicted. Generally the problem is that people will discover squatters and have to spend tens of thousands of dollars in legal fees spending months fighting them in courts all the meanwhile they continue to trash the home and pay no money. Then the people who get their homes back at the end are left with a ruined house and months of bills stacked up that are now their responsibility.

It can also be used as the basis for a scam. One of the recent stories somebody posted on ce had the guy who was squatting tell the owner that he had put a few thousand dollars of work into the home and that he would move out if she just gave him the money. So there's definitely a financial incentive to effectively hold people's property hostage knowing that they're two options are either pay you to leave or spend half a year forcing you out while you trash the place.

Also its a somewhat frequent thing with short term rentals like Airbnb where people book for weeks and never leave, cause now the time they spent in the house qualifies them for squatter rights.

Fuck squatters. Most of them are despicable people. I known a couple who where drug addicted scammers.

This too. The people you read in squatters stories aren't homeless people just finding a place to stay warm. They're scammers and con artists abusing the system. It's like when there was the eviction moratorium over covid and some renters (an extremely small percentage, I'm sure) decided that since they couldn't be evicted they would just stop paying and save up like a year's worth of rent to go somewhere else.

Fuckin crazy. Having gone from homeless to home owner, if I found someone else just living in my house, I would be absolutely fucking livid. Dunno how I would react. Really messed up that last is(was?) structured that way.

Castle laws should apply to squatters.

If someone owns a house and uses it solely for temporary rentals, that person is hoarding a valuable resource while failing to meaningfully service society. Squatters are doing the lords work in such scenarios.

I can't wrap my head around breaking, entering, and never leaving ever being ok. If I went away for a month and found a bunch of crackheads living in my house I'd be ready to fight to the death.

It's a bit more complicated then that. Squatter laws exist so that land not being used doesn't just sit around unused. Someone who owned land stops using it and it never gets sold for someone else to use or ownership document has been lost to time.

Exactly.

Squatters laws have been around for almost as long as the US itself, but was originally intended for it to cover literal "land" not being used by the owner, and not homeless people breaking into unused houses and apartment buildings where the owner may be mid-renovation or in the process of developing to attempting to resell the property.

Castle laws are laws that allow for the use of lethal force in the defence of one's home in some (mostly) US states without any further requirements like an immediate threat to life/safety.

The common law principle of castle doctrine says that individuals have the right to use reasonable force, including deadly force, to protect themselves against an intruder in their home. This principle has been codified and expanded by state legislatures.

Basically, if someone is on your property, and it looked at as a threat, the first move is to retreat and go get help from authorities, but once they enter your property, all is fair game.

Squatters are trespassers/burglars, and should be punished as such.

In New York, you have the right to protect yourself - and your home.

One of the more defining parts of New Yorks castle doctrine law is the duty to retreat. This means if a person sees someone in their yard or on their property who is perceived to be a threat, the person has a duty to retreat first if they can do so safely. However, if a person is inside of their home, that does not apply.

"If you're just in the yard or something like that, you can't use lethal force," said former prosecutor Brian DeCarolis. "You can use non-lethal force to theoretically scare them away."

This concept differs from state to state with 'Stand Your Ground' laws. This means there is no 'duty to retreat' before the use of deadly force. The defense of a business using deadly force is authorized in certain cases.

"If they're actively burglarizing your business, the law does give you in New York the ability to use deadly physical force in that situation," DeCarolis said.

Yeah, I'd agree. While I'm not in favor of squatters by any means, they should be arrested, not shot.

On the flip side we ALSO need laws that clamp down majorly on landlords, but that doesn't mean squatters are not also a problem. It just means we have two problems.

To clarify my statement, i do not endorse just killing squatters. That is messed up. I want to emphasize the reasonable force, as in a homeowner being able to physically remove a squatter, i.e. pull an Uncle Phil on DJ Jazzy Jeff type move.

Generally it was an unused commercial or rental property. One significant defense against such squatting is that these people cause fire risks. Typically said squatters are not going to squat on a property that currently has plumbing or at bare minimum electricity and natural gas services. Unregulated tent cities have an even bigger problem with this. I also agree with Oregon's laws that prohibit squatting near or on major pathways to schools. (I don't know if this includes people in campers or not, but IMO it shouldn't) Most of these people are addicts and/or mentally ill, many of whom engage in antisocial or worse behavior. It is one thing for adults to have to put up with this, but children walking to school without adult supervision lack the skills or resources to handle it (and the trauma has far more deleterious effects on them) I again, disagree with including homeless people illegally parked in campers in such ordinances, because they are far more likely to have their shit together and are simple victims of poverty -- in these cases, the ordinance should only apply on a case-by-case basis. (Child and teen sex offenders also should not be permitted to purchase rent or housing in such areas, but IMO this should not apply to people on the sex offender registry whose history only includes adult victims.)
